I wouldn't touch these domains if you sold them for a buck.

Always be careful relying upon old editorial. The JohnTesh.com case never went to final decision and was never a reported case. Individuals haven't had as much luck with ACS/ACP claims, and there clearly are ways around it. See, e.g., Lamparello v Falwell, 420 F.3d 309 (4th Cir. 2005), cert. den. 126 S.Ct. 1772 (2006).

Illustrates, though, some of the other factors (e.g., legal risk) that should be considered in a serious appraisal. Anyone interested in buying them would need to factor in the risk of litigation and civil penalties when buying them.

The New Act's Protection of "Living Individuals" as Well as Trademarks

The Anti-Cybersquatting Act forbids trademark cybersquatting if the offender:

(i) Has a bad faith intent to profit from a mark protected by Section 43 (of the Lanham Act), and (ii) registers, traffics in, or uses a domain name that is:

(A) identical or confusingly similar to a distinctive mark;
(B) identical, confusingly similar, or dilutive of a famous mark; or
(C) is protected under 18 U.S.C. 706 (Red Cross) or 36 U.S.C. 220506 (Olympics and related marks).

The Act goes on to state:

Any person who registers a domain name that consists of the name of another living person, or a name substantially and confusingly similar thereto, without that person's consent, with the specific intent to profit from such name by selling the domain name for financial gain to that person or any third party, shall be liable in a civil action by such person.

- Just a little light for the issue, and in lieu of an appraisal they are not worth much, I should say the reg fee. by own experience it is a bad combination when you add the word NUDE to a celebrity name. not only it infringes TM, but also it can be consider defamatory and that my friend will bring you a heap of legal issues - since you are implying that in that domain/website your visitors will be able to see them .. NUDE .. specially the celebrities that are listed there .....

Just my opinion .... good luck with those names.

I think this is the same like "Grip Site".

There are still a lot of domains available like you have shown with the word "nude" after celebrities.


I dont think they worth more than reg fee. so I would suggest trying to delete and refund(if applicable).
