Yes, dangerous - but still worth something to specific buyers. Some people don't care about TMs, and like to gamble. The rewards can be amazing at times because only a percentage of people get in trouble. Hard to police the world. The datsun brand is old and discontinued anyway.

Even if you reg afowEfjaEFijawef.com you are still open to lawsuits. You can't live your life in fear. I'd personally make a datsun memorial site, or fan site, etc. Your revenue from this could be outstanding.

I would definately check on the TM, because if you sell it, you can still be held accountable for mis-use. I used to have a Datsun 25 years ago lol.

Like MJ said..some people won't care that it's a trademark. Some people like to gamble that way. So if you can get one of those buyers, you might get something for it.

As for sale to an enduser, where the real money is....forget it. Why pay for something they can just take away from you.

less than reg fee unless you find the gambler type. Personaly...I would get rid of it.

HUGE TM - The Datsun trademark is owned by NISSAN! 'they have a domain sueing history as we all know, and ts still going on for nissan.com.

Not that familiar with Registrar.com, but here is a technique that was recommended by Daniel over at that other forum (where I appraised your Illusions.net a week ago). It is good for TM problems:

Create an account at the registrar using a different name. Then transfer the domain into the account. Then delete the name after a few days to make sure all records are transferred. That way the last holder is not you. Also, some registrars keep the records of the last holder in the whois after they delete the domain. If you have read Daniel's posts, he has a lot of tips like that for TM problems.

What about names like Honda or Suzuki..I know honda is a Japanese surname and I think Suzuki might be both a surname and geographical location. In eitehr case would these not be allowed, providing you are not advertising vehicles..could you not offer both of these for sale even to Honda or Suzuki directly without infringing copyright? Any thoughts? I saw that Toyota.me was sold for thousands.

Toyota.me was a stupid purchase. The same person bought Porsche.me and lost it in a UDRP.

However if you want to look at a way you can avoid a TM look at Nissan.com, Nissan has spent millions trying to acquire it.

UDRP takes three parts.

1.) TM or Name Infringement
2.) No legitimate reason to own the domain.
3.) Using a name in bad faith.

If your name is something like Joe Suzuki and you have a non infringing website at JoeSuzuki.com or SuzukiDesigns.com you should be fine.

However, if your domain is a blatant TM violation like SuzukiCars.com then you are playing with fire.

Thanks Brad, but what about if your name isnt Suzuki- perhaps you could set up a blog page about some ancient Japanese artist called Yoji Suzuki to get around this problem, and then still offer to Suzuki motor company after letting them know what you're using it for? Sounds crafty I know, but wouldn't this be a possibility to get around the TM issue?
