Hello,
I Hand-registered webbate dot com a few days ago and received the following email :

As per our records, it indicates that your company has registered a domain name webbate dot com which is a registered property of Webbate Media, INC USA, and Rahul Sadarangani & Companies Private Limited India.

We are sending you this mail on a mutually that it would be better that you can transfer this domain name to us or else a Request for the Same will be put through ICANN as .com domain and a Complain against your registry will be issued for same as we had contacted your registry.

Our Company would prefer if it can be done mutually would be great or else let the ICANN take a decision. If we do not receive a mail until Tuesday 7th June 2016 1800 hrs an automated email will be send to ICANN.

I checked on TESS and there are two dead TMs for "webbate"
Also checked whois history on DomainIQ and the domain had expired since the end of september 2015!

I wonder what to think about a company that owns the .net and does not register the .com for 9 months and then wakes up whan I hand register it.

Should I even consider their request ?

If you registered the domain in good faith and you're not infringing their TM, then they don't have any right to demand it from you.
However, they could file a UDRP, even if they don't have any grounds, which would require you to defend your position.

One sure sign of "someone who doesn't have a clue what they are talking about" is the "I'm going to complain to ICANN about a trademark dispute." The entire reason for the UDRP structure is to get ICANN out of the loop on these things. ICANN doesn't give a rat's ass if someone has a trademark dispute. That's what the UDRP is for, and it is not administered by ICANN.

I don't have an opinion on the underlying claim, but this guy is clueless.

This is borderline hilarious.

So they set up an automated system to send an eMail to "ICANN" if you don't respond.

What a joke.

The fact that they did not register a domain that was readily available for 9 months will defeat any UDRP that they file... IF they even file it.

Don't even answer this nonsense.

I received an eMail from a company in Brazil claiming that they once owned my domain, and that they would like for me to transfer it to them. Due to the fact I'm not brain dead, I knew for a fact that the domain had one previous owner since the 90's and it was NOT them.

Some companies will just spit out some nonsense in the hopes that you are a 'lazy domainer' or 'idiot squatter'.

An amatuer scammer it seems. Tell him that you have already 'complained' ;) to ICANN about his attempt to threaten and intimidate you, and to try to rob you off your legally owned domain, and if he does not apologise before the next black friday :lookaround:, an automated complaint to the INTERPOL will be followed. :laugh::laugh:

Thank you all for your answers, I'll just ignore them and if they come back to me I'll

- ask them for a proof of trademark
- explain I registered it in good faith
- remind them that the domain was free to hand reg for about 9 month...
