I have a .mobi domain name which I registered to provide data storage eg photos,documents etc..,email services,dating and many more.But I discovered that the name is also been used as a package and TM by a bank in the USA on banking relatated services.Can I sell my website in the future?or Do I need to tm it before selling?

Yes, you can sell a TMed name (you didn't ask if you can legally sell a TM domain, then the answer is no), it happens all the time. Can you still be liable for registering the name in the first place even after you get rid of it, heck yeah. Can you lose of the revenue you gainged from the domain, sure can. Maybe I jsut don;t get what you are trying to ask.

I registered a domain name last year,it is an insurance parckage.I discovered that someone registered a company in the same name and is running an insurance company.They have just applied for the TM and it is not yet aproved.Can I still sell my domain name?

well if its not approved yet they dont have the TM yet do they? so i would say you could legally sell it but if they do get the TM approved i dunno whatd happen then

Learn then post please, research trademarks in this section and you will see how wrong you are... ugh

For the lazy people who won't do their research ( and in this case simple basic research), a TM does not have to be registered to have TM status. If they were in business before you registered the domain, then you squatted. Research the penalties.
