C and D to a collection agency..Paypal

Hey,

I recently sold a phone on ebay. The buyer and I agreed that he would pay through paypal. I messaged him immediately as soon as he won the auction and he promised that he would pay within 24 hours...

After 48 hours I messaged him again that I was travelling interstate and that i would not be able to post if he did not pay within next 48 hours.


I got no response.Later I started travelling and he paid the money meanwhile..After 7 days when I came back I discovered that the buyer had paid 5 days ago and that I decided to send the phone immediately.It was about thursday evening and so i sent the phone on friday...

On sunday the buyer filed a claim for refund.However I suspected something similiar would happen so I had withdrawn the money to my bank account..My balance went negative and I was asked to pay paypal the 300 bucks...That way I was out of the phone and the money...

I called them atleast 5-6 times (every time 30+ minutes on hold) withoug much response and resolution.

I abandoned the account and after a month I get a call from a collection agency..

Since then I got atleast 4 calls and more than 5 letters to pay.Since I figured that the collection agency was not the original debtor I had write a C and D to them.

Is there a way I can do it myself...Or I neeed a lawyer ?

I don't know Australian collection agency law but it seems to me that you owe paypal $300. Does Paypal offer seller protection to Australian residents? Did you ship to a verified address? I never understand why sellers (and buyers) are not more cautious.

I`m actually suprised that PayPal did not get money from your bank account.

Yeah I did ship to a verified adress..the worst thing is in my defence I even faxed them a copy of the receipt..They claimed they never received it..then I scanned a copy and put it up for them to see...

Today I called them up and the girl said "I am not sure why the buyer was refunded ..It seems it is our mistake ..I know you put the document up but am not sure why the case was ruled against you.I am sorry I cannot give you more than 50 $ credit but I will speak to my supervisor tomo morning and see what she has to say.If hse permits me I will refund you fully.I will also contact the buyer and ask him to pay"

What a terrible mes...

"and ask him to pay" ... um if he has credit or any kind of account on file... re-debit the money from his account... that simple.

I got the money back Paypal is not that dumb...She talked to her supervisor and they said sorry and refunded me completely...(still about 8 bucks short) .. .I dont know whatever happened to that buyer...Hope he dies in hell...
