Hopefully "Lots" will revisit here soon to clarify ... perhaps he's seen either the logo or something within the content of the site somewhere else (Servicemark question), or has some unique knowledge as to a potential UDRP with the domain name (Trademark issue) itself.

Is it legal to sell fake merchandise? I am interested in knowing the answer as you are profiting off of someone elses TM'd material.

My sunglasses do not contain any names or trademarks. We sell "look a like" sunglasses, also called "compare to". What it means is compare the look and price to the originals. We are not infringing on anyones copyrights. It would be different if someone sold a pair of fake oakleys that actually says "Oakley" on them. I went to see a lawyer about this. As long as people know they are buying look a likes, it is legal.
