Does anyone know if its legally "okay" to put a domain in auction (sell a domain) that is still in transfer lock? I think if I explicitly state that in the auction description it should be okay, right?

Even if it is under 60 days transfer lock, you can push the domain to the said user's account at same registrar. If he wants to move away from this registrar he can do it once 60days period is over. Its simple.

Or the 60 days transfer lock due to registrar transfer or new registration?
Transfer lock only means you cannot transfer it to another registrar. If the auction is on GoDaddy, then when you receive the domain it will have a fresh 60 day transfer lock. But you can still push it to somebody else at the same registrar.
I have sold several domains on Ebay few days after I register them but always specify on the listing that the buyer as a mandatory requisite to receive the domain must have an account with the current registrar of the domain.
