As many of you are aware I had a falling out with one of my developers who just recently joined this forum and started selling some scripts that he worked on while working for me. This developer was employed since December and was a trusted employee whom I even advanced pay twice too.

This developer had also worked on some of the sites I did for clients of NP. I had contacted both my attorney and law enforcement and the matter was quickly resolved with the site in question being taken down.

Because of this employee whom I trusted alot of projects were not always finished on time, or to satisfaction, which had resulted in me refunding some of you. I do apologize to the community and will now move forward with rebuilding my business which I am doing all the development myself so this will not occur again. I will also try to become more active in the .mobi section again as I move forward.

Give the guy a break. It can be very tough making a living on the Internet.

I've been at it now for over 11 years and I have never had to pay a cent for software since there is so much good quality free software out there.

Thank you for your honesty, Michael. :) I was one of the clients that Michael refunded, in full, because of these issues, although I can clearly see it wasn't directly his fault. I expect you have gone through considerable pressure over this recently and wish you better times ahead. I hope it's now behind you and I would also say it wouldn't stop me from approaching Michael for his services again in future.

Also on the plus side, Michael has remained incredibly patient, very professional and communicative throughout the problems he has experienced and I have appreciated that. B-)

I'm a bit confused by your comments, one guy apparently stole property from an other. What break does that deserve?

I'd be very surprised if not one bit of any of the software did not originate at sites like sourceforge.net. If so I don't think either party has the intellectual right to it. Also, how does one prove that none of the software was done outside of the paid effort.

I've been a software engineer since the mid '60s and know that today's environment for developing software is a lot different than what it used to be when software was pretty much the property of your employer. And even then I don't believe companies would call in the police so quickly for a problem with an employee.

What about forgiveness vs. extracting a pound of flesh. It just seems rather harsh and hastely done.

If i had it my way I would of visited him in person but i have to much to lose. If you pay someone tens of thousands of dollars to work on countless projects (all work-for-hire, I may add), you advance them twice in pay, you put up with missed deadlines and then have to try to explain to your clients their site will be done, and then more missed deadlines, and more mad clients, and then he sells code created for clients, and in-house on another website for a fraction of the price.... I don't think I was harsh enough.

I worked as a webmaster for several years starting almost a decade ago. It never would have crossed my mind to do what this individual did to Michael... Let me tell you that whether it's written in the contract or not, this behaviour is not to be expected and is inacceptable. If someone's paying you to develop software, a website, ... on the internet, it's because they didn't want to use the software (or web design) that everyone else has. They want something different (or better). vBulletin (Namepros forum software) is an example of that. Would it not be wrong if you were to illegally share vBulletin for free?
