No one is going to buy a celebrities domain, so they can have legal problems instead of you. There is a reason it was available to reg. Drop it and move on.

I'm not sure how you can make money from celeb names, unless you start a fanclub of course. I reg'd HarlemHeat.com some years ago without doing any research. It was on a drop list, and I thought it would make a great porn site. Harlem Heat was a professional tag wrestling team, and they were great wrestlers. Out of respect for them, I didn't ever develop the site.

You can give it to them without any strings attached, and hope to be rewarded after the fact.

Kinda like putting in some karma work.

Many domainers are now familiar with the remarkable news item reporting that Toronto Raptors
NBA star Chris Bosh won a judgment for $120,000 against a domainer, Luis Zavala (Hoopology.com), for registering ChrisBosh.com. The judgment apparently came down in April, but then Bosh’s lawyers reportedly convinced the judge to order that the domainer’s 800 other mainly sports and celebrity domain names domains be handed over to Chris Bosh as well, since the defendant wasn’t likely to pay the $120,000 judgement that Chris Bosh had obtained in an action under the Anti-Cybersquatting Consumer Protection Act, for cybersquatting.

What did they do with the 800 domains they won?
“I will offer the return of the domain names free of charge, but I’d also love the opportunity to show their owners how Max Deal can help.”

Person's names are as protected as trademark names. All they have to show is the 'intent'.

Mike Rowe took this to one of thedomain boards I can't remember which one, but it may have been DNF. Most people seemed to think that he should have continued the fight, but I think he did the right thing by accepting Microsoft's offer. It must have been a great help to him as he started his career.

Same name as yours - then you are fine, but if you try to sell it to celebrity, then it is not. 'Intent' that is what matters.

If the celebrity isn't offended, and the domain is offered at a reasonably price (less than legal fee's) than the celebrity might buy it to save time.

What if the domain is bought by another domainer, and that domainer is sanctioned to a lawsuit from the celebrity? Will you still be implicated?

Well, if that domainer is getting sued, it must be his own fault (using celebrity's personality).

I do not think there is any difference between public or private sale. 'Monetary Gains' is the keyword here. You do not have rights to the name if

a) You cannot prove that it is for your own personal use
b) You cannot establish the relationship to the name
c) You cannot prove that it is not registered solely for monetary gains

All three points above point to 'intent'. Not related to celebrity, classical case is 'Nissan dot com', owned by person who ran his business as Nissan computers, and his last name is Nissan as well. Nissan Motors has lost all their cases.

What if the domain is bought by another domainer, and that domainer is sanctioned to a lawsuit from the celebrity? Will you still be implicated?

If you are selling the domain to another domainer, and there are no terms in the sale such as 'you are not aware of trademark violations', you cannot be sued by buyer domainer. If you have legal agreement for sale, make sure to enter the term that violation of agreement (called "severance") is capped by the amount it is sold for.

Celebrity cannot sue you since you are not directly selling to them.
