GoDaddy - Won auction - Can I force the sale?

I bought a domain at GoDaddy auction at a " Buy Now " price and it has been paid for by credit card for quite a while now. It appears to me there is an abnormal delay in getting the delay into my account.

I checked WHOIS and the domain is actually registered at godaddy and should have been in my account relatively fast.

So what if the owner of the domain had second thoughts and decided not to sell, as in reneging on the deal. Because his domain is sitting at godaddy can I somehow force the deal?

I mean if his domain was a namesilo or something I know I would be up the creek without a paddle, but given that it's sitting at godaddy there should be a way to enforce the contract right?

Everyone please don't tag Joe from godaddy with this, he has enough on his plate without having to worry about my little problems.

I buy a lot of domains through Go Daddy. I always pay within 48 hours. usually within 1 hour. But it usually takes a minimum of 10 days before the name is transferred into my account. If you are concerned you can call Go Daddy and they will assist you at no charge.

Over a year ago Dynadot.com was being auctioned on godaddy.com and I was the high bidder. The auction ended early. I suspect the seller didn't have a legal right to sell the name. I know I wouldn't get the name. I was bidding for fun. But I would have paid the money and I would have accepted the name if it was in fact a legitimate auction.

I won an auction on ebay.com for dump.com the price was $5,000. The person auctioning the domain finally admitted he didn't own the name nor did he have the ability to transfer the name. There was no way I could force him to transfer the name. I didn't lose any money.

I'm getting a number of PM's asking me what I emailed the owner of the domain to get him to react. I will post it below but keep in mind it has a couple of minor edits to remove personal information.

I purchased domain1 from your godaddy auction at the buy now price. It has been a number of days and you need to follow through with your sales agreement. Upon due diligence I see you have also listed the domain on sedo with a buy now. That is not a wise decision because I have a bill of sale from Godaddy for the above stated domain. I have notified sedo that the domain was sold and will be in dispute if sold to anyone else. You should never list on more than one platform with a buy now price.

I purchase a lot of domains and usually the process is quite smooth. Hopefully your intentions are to follow through with the sale as specified on your godaddy terms which you agreed to when the domain was listed.

Please remove the domain from sedo and let me know your intentions as far as the sale is concerned. Check your godaddy account to see the status of the transfer.

Please note, as far as my company is concrned we have a binding agreement and any intend to sidestep this agreement would force me to send it to legal and file a domain dispute.

My main question is....

Go Daddy has both buyer and seller agreeing to godaddy terms.

GoDaddy is the registrar for the domain in question.

Can godaddy force a sale?

Forget the type of domain, mine or anyone or .com etc.

Lets just talk generic .com

GoDaddy has all the control being the registrar in question and they have a two party agreement.

Can they force the sale?

Better yet.... should they enforce the sale?

THAT IS REALLY WHY THE TOPIC

Please don't confuse my deal with the actual question at hand.

I’m flying and the WiFi is bad so I’ll keep this short.
In many of the auctions we automatically move the domain to the buyer between Day 5-6 if the Domain is registered with GoDaddy. We’ve worked hard to stay within the law and policy and make buying and selling domains more seamless which includes automatically moving domains to buyers.
There’s several caveats to this. If we can move a name we do. If we can’t we’re happy to step in and help nudge the seller and get the transaction moving along. In the worst case we will ban the seller. Most people want to sell the names they list and almost all deals are pretty seamless. If they’re not we’re happu to help.
