Even Estibot has a TM check, and they are rel small, how can someone with 300,000 domains not check for the most obvious TMs.......when they are immediately faced with a UDRP ? Let's be serious now :)

He could take a list of the top 100-200 brands in the world, and in less than one hour he could weed out most of the names I listed above from his portfolio. Instead he renews them for years and continue to add more TM names to his portfolio. Don't think for a second that he is doing this unintentionally because his dropcatching software regged them for him.

Somebody that does not intend to cybersquat is not going to own that many TM names. He even regged more facebook names after losing an UDRP against them!

And his TM names are so contextually relevant that there seems to have gone some human thought into a lot of them. The TM word is often coupled with a word from the same industry as the TM.

So how did he do it? Part software power, part human power. He starts with a tool built in-house that, among other things, sifts through Google-friendly keywords, looks at traffic potential, filters out obvious trademark violators, and then ranks and scores possible names. Then comes the human part.

"We have a filter, but I'm the world's most efficient human filter for this sort of thing," said Mann, true to form. "I don't think anyone can read huge lists of domain names as quickly as I can and understand what they're reading. I'm a pattern reader. It's a huge pain in the ass, but it's what I do for a living."

Then the machines take over. "The robot just goes to the registrars -- buy, buy, buy," he said.

BIG problem. As trademark holders, these companies are supposed to enforce them or be at risk of losing them. Sometimes Microsoft would allow training companies to use Excel trainers (they also own the trademark Excel) but that helps them make money. I doubt these companies would view domainers who profit from their names in good light, nor should they if they want to keep their trademarks.

Nearly all the domain blogs write up a new article every time Mann reports sales, 1-3 forum threads take off as well, and the NP blog also covers his sales. I have never seen any of the domain blogs take issue with his blatant cybersquatting, and if they really found it problematic, they wouldn't be covering his every move like he is a true leader of this industry. Mike Mann tweets or posts something on his Facebook page, the domain blogs treat it as news. And on NP, I've only seen two NP members calling him out on this on multiple occasions.

When Mann is constantly given so much positive press coverage and attention, it normalizes his approach to domaining and make it seem perfectly fine (yet everyone would rip into a newbie who intended to profit from the kinds of names Mann own, and tear them a new one if they refuse to change their ways - what's the difference when Mann tries to profit off microsoft/google/sony/facebook/samsung/etc. TMs year after year?). Mann would not be covered in the way he is if people had a problem with his approach to domaining.

The domain industry legitimizes Mann’s cybersquatting, as the domain blogs (“industry thought leaders”) and domainers do not take a strong stance against it. Instead there are new articles and threads praising his sales every other week. When there is such a consensus about his approach to domaining, his behavior comes to be seen as acceptable and normal.

Why are you putting the onus on the victims of cybersquatting?

The issue here is not that Microsoft has not sued Mike Mann yet, it's that Mike Mann owns a bunch of microsoft domains in the first place.

I was not able to find a single big global brand TM domain among their inventory. This is so easy to avoid! Just create a blacklist filter and add all the big brands like google and microsoft to it.

However, Mike Mann actively cybersquats, so he will not do that: In 2013 he LOST an UDRP against Facebook, and he was ordered to transfer the domains he was cybersquatting to facebook:

The issue here is not that Microsoft has not sued Mike Mann yet, it's that Mike Mann owns a bunch of microsoft domains in the first place.
I'm not putting anything on anyone. I'm saying that's what the US Trademark office clearly states:

Does everybody open/read all "Mike does it again" and similar threads on this forum? I'd say it is unlikely. Tracking individual sales of any domainer is a timewaste (imho).

Yeah, he owns GoogleMicrosoft.com since 2010. Could've given the domain for free to either company. Could've let it expire. Risk/reward maybe...

maybe that's why he still owns it - neither (google or microsoft) company can claim an exclusive TM and neither company would be allowed to own it - its kind of funny if you think about it
