Over the past few days, the domains BS.com and XS.com have been sold. There is one more two-letter .COM domain name that may be about to sell, and that is SW.com. The domain name was listed in the NamesCon extended auction, but didn't sell after reaching a final bid of $601,000.

Very recently, SW.com's WHOIS data has updated and the registrar status has moved to "OK". This could be indicative of a domain sale.

Investor and President of Leap of Faith Financial Services Inc, George Kirikos (@GeorgeK) has urged domain name registrants to submit comments to ICANN to protect a domain name's legal rights to due process.

George explains that intergovernmental organisations (IGOs) want to eliminate a owner's ability to use the courts to defend their domain name. If this demand from IGOs is approved, it could be detrimental to the rights of domain name owners.

I Sold YCHT.com at BrandBucket

Domain investor @frank-germany announced the sale of one of his four-letter .COM domains. The sale, which occurred at BrandBucket, was thought to have been valued at $9,995 although this is yet to be confirmed by the seller or BrandBucket.

Nonetheless, it's an excellent example of the value that a four-letter .COM can have outside of the Chinese wholesale market.

Someone Is Trying to Trademark My Domain. Should I Challenge It?

After registering a domain name in October 2016, this domainer discovered that in January 2017 an American business applied for two trademarks. These trademarks match two domains that this investor owns, including the domain registered in 2016.

Having declined a $10,000 offer for one of the domains, should this investor be concerned about potential legal action against his domain name? Should they challenge the trademark application?

Are New Domain Extensions Plateauing?

According to this discussion, the growth rate of new domain extensions such as .CLUB and .XYZ are starting to plateau. Statistics suggest that a 90% drop in growth rate has seen new domain registrations slump this year, in comparison to this time last year.

Does this mean that registrations of new domain extensions have plateaued? This comes alongside the news that .COM registrations have surpassed 128 million this week.

How Many Domains Do You Need to Get an Offer Per Day?

Depending on your portfolio size and quality, you may receive hundreds of enquiries, or very few. Domainer @Asfas1000 has asked how many domain names you would need to own in order to receive an enquiry or offer every day.

The consensus seems to be that you do need a couple of thousand domains in order to receive enquiries every day. However, a good point has been made that if you own a small amount of very high quality domains, you may receive several enquiries per week.

Update on Mar 3, 2017: SW.com moved to ownership under privacy protection in Hong Kong, which would suggest the name has indeed been sold.

Re: Trademark of domain name. This snippet doesn't give the details it should. The simple answer is that the domain name owner has common law rights to use their domian name in the way they were using it before a trademark was filed.

A trademark can be filed in one category bt one registrant and another category by another registrant for the same exact name.

The trademark site explains that a domain name is simply a web address and while you can have a domain name that is identical to your business name, a domain name can't be registered as a tradmark (and with no commerce as well).

Another thing to consider is that if you have a domain name parked and you're not using it, and someone trademarks a name which is also your domain name verbatim, you don't have common law rights to use it for the same category as the trademark. I.e. Clothing line or auto parts. These two different categories can have the same name and be trademarked in different categories and have the business name for a domain with two different extensions.

I have seen people trademark an entire domain name such as firepants.com

Most of these registrations are cancelled by the trademark office.

As mentioned in the introduction to this week's Top Topics, we noticed the domain SW.com was likely sold. The name has now moved to ownership under privacy protection in Hong Kong, which would suggest the name has indeed been sold.
