I have the Domain xboxhack.net right now at $60.
Do you think I could make more on this on a better site? (I'm using a targeted hacking site) or is that a good price?

This domain is a liability. There is a blatant trademark. Furthermore, this domain holds negative connotations toward the trademark itself. I would advise you to read up on trademark law, cybersquatting, and UDRP before registering anymore names. If this is a recent registration you may be able to get a refund. Contact your registrar for more information on grace deletions.

Well its a TM and selling this name to someone else is also not advisable. So better drop it

I'm sorry, but microsoft is known for protecting their marks. It is in NO way generic and has no alternate use. Giving new users false information that could lead them to legal trouble doesn't sit well with me.

let me know why microsft take .com in 2011 and let the .org reg in 2010 with the owner ! i am not say buy or sale TM but i say what to do when you own domain with TM !

What you should do with a TM domain is, drop it, delete it if your registrar will let you. The reason is incredibly simple: you can't do anything else with it, without incurring risk. It is possible that you could build a successful fan site, that you could sell the domain, that you could park it and earn a few pennies, etc. Different companies pursue domain TM matters with different degrees of ardor. But the fact is, no matter what you do with it, you are exposing yourself to unnecessary risk. I don't care two flips about trademark law -- but I care a great deal about the balance of my bank account. So I try hard not to do things that endanger the balance of my bank account, such as screw around with TM domains. It is precisely because the risk is unknown -- it is incumbent upon the TM holder to take action -- that TM domains are so risky. You just never know; there's no "rule of thumb" with what you can and can't get away with, because even if you feel confident that you fall outside of the WIPO guidelines for bad faith usage, you can still be required to respond to an inquiry, thus incurring expense, time and hassle that will generally be more than the domain is worth (even if you win the case.)

The fact that some domains which contain a trademark, whether extant domains or theoretical ones, have not been registered by the TM holder is completely irrelevant to the issue of the trademark's existence. So just because MicroSoft took a while to get the .com and hasn't done anything about the .org does not mean that the .net is safe. If the domain has a TM in it, and the TM holder feels like doing something about it, they can -- and (crucial point here) even if the domain owner passes the WIPO smell test for bad faith usage, he is out time, money, and hassle that will generally exceed the value of the domain.

It is just a no-win scenario, nothing at all about "trademark is wrong!" or anything like that. It's just a game that cannot be won by the majority of people who are domaining. And so the reasonable course of action for an experienced person in this business, is to attempt to help people who register TM domains by telling them to drop them, because they are for all intents and purposes without value, and may actually have negative value.
