well they can take it away if they wish, but they probably won't bother, then again if they do bother, you'll have to give it up...

If in any way you attempt to make money with it whether by parking developing for profit, or selling, probably yes. If you don't make any attempt at profit, they may just leave you alone or decide to make an example of you. You just never know.

Makes you wonder why you would want it then, huh?

well...if you do a fan site you "should" be ok. nintendo doesn't have the fame to knock down fan sites.
but there aren't 100% certain in anything.
