.mobi Trademarks after Sunset

With .mobi having a sunset period for companies to register their trademarked domains, does that leave the field open for regging unused names? If the company can use ICANN to get the name back, then what was the purpose of the sunset period? The companies are protected anyways.

I found one that is probably trademarked but is unregistered and it fits the .mobi extension very well. I am a little reluctant though.

I am also wondering if owning a .com domain name will give the owners the right to take away the .mobi. I think a lot of .mobi names will be lost if it is case, as virtually anything worthwhile is already registered as a .com, .net or something.

Trademarks before sunset or after sunset are still trademarks. There is high risk involved especially when you know that the word(s) is trademarked.

Owning a .com of a particular GENERIC word may not give any rights to snatch a .mobi

Thanks for the replies. This particular name was trademarked at the USPTO in but the trademarks are all listed as cancelled. A similar, but different, name is trademarked in Canada. It looks like the company fell asleep somewhere and didn't bother to renew in the US or does one countries TM affect other countries. IE. Does Canada's trademark system hold water in the US. with ICANN? If so, a person would have to check every domain name in evey country for TM issues, not just the US.

Should have checked first perhaps, but they are not protecting their .com so I suspect they are out of luck or not interested.
