.mobi Found a great mobi of a trademarked name .. need advice

found a great mobi of dot com name that is trademarked (by some very heavy hitters .. corps with a lot of cash and big legal departments)

i really like the sound of the mobi name, think it can be a great name on mobi

if this name is tm and has a dot com am i okay to take it as long i don't do anything remotely similar to the trademarked dot com product?

i will stay completely away from what they are doing, my product will be completely different from theirs

is this a fairly clear call or is there still some gray area

i get the feeling that with tm it is never black and white always gray

if you stay "completely" away from their subject your ok...example apple computers and apple the fruit...

And on another note are you sure it is TM?

if its google.mobi / paypal.mobi which are not generic terms then you will pretty much end up handing over the name.

Not in all cases. Again, PayPalSucks.com. PayPal tried unsuccessfully to get the name. Here is some info from their site: http://www.paypalsucks.com/domain-name-disputes.shtml

Im not saying equal uses I mean if its actually the name "google" or "paypal."
