I have a question regarding using a trademarked name

say im building a sites selling or promoting nokia phones ?

am i able to purchase nokiaphones.com ? and promote through this domain ?

does this violate any laws...

do i need to contact the company at all ? whats are the steps needed to safely achieve what im looking to do..

I don't think it would be in your best interest to go try and buy NokiaPhones.com as Nokia owns it themselves. ;)

If you register a trademarked name and you're going to be selling products relating to it and cashing in on their trademark, then you're just asking for trouble. Your best bet would be to register a general cell phone domain that doesn't relate to any cellular phone brand or provider.

... i will be promoting their products via affiliate program... through one of their distributors....

Read your affiliate terms.

All legal issues should be discussed in the legal disputes section. That's what
it's there for.

If you're joining their affiliate program then that's different. But I'd still avoid buying or registering a domain with their trademark. I'd stick with something generic that doesn't contain their trademark as when individuals knowingly register trademarked names, then that's just asking for legal trouble. These companies have spent millions to build up their name and will spend millions to protect their investment as well.

but it has nothing to do with the affiliate

product - afffiliate - my site

im not using the affiliate trademarked name.... im using the products name...

I believe you would get into trouble with Nokia's legal department if you were passing yourself off as nokia phones. If you had nokia in your domain name and you only sold nokia phones your potential customers might think you were nokia. Which means you'd be passing yourself off as Nokia and you will need expensive legal advice to deal with nokia.

some more information.....

i will redirecting to their distributor.... so nothing will be sold on my site at all....

i just dont see how different this is ... compared to for example honda
there are plenty of dealership sites out there that have honda in the domain names...

Check your affiliate/distributor/wholesaler terms.
