I've owned a domain since 2003.

Now I get an inquiry of interest to buy the domain from a company that since has trademarked the name.

But this is after I bought the domain. So I bought the domain before they trademarked it.

If I reply to their email they can say look he offered to sell it and sue?

What to do as I once had plans for the domain but never used it.

if you do reply and tell them that the "domain is not for sale", because you have plans for it?

then what?


i'd go with the latter, if it was mine.

You may want to include that you have development plans for the domain in place already.

This might make them realise that you are more serious about the domain rather than just "holding" it from them.

You want to avoid any arguments about trademark issues related to the domain, because you already know that you are in the right. Keep any reply short and sweet.

Is the domain parked? This might portray a lack of interest in the name. Also is it listed for sale?

Just be careful, you don't want your name taken away from you by some big cheese especially when you had the name before them.

Make sure if the domain is parked, it isn't offering up links to services related to the company that contacted you (or better yet, unpark the domain and keep it unparked). Unfortunately, bad faith has trumped the other supposedly necessary factors that a UDRP needs to be successful on many occasions, and even if you try to indicate you were not using it in bad faith, a parked page with links competing against the complainant will always indicate bad faith in those proceedings.
