Hello,

Does anyone know what is the total expense involved in filing a UDRP complaint ?

I know the fee is 1000 USD, but apart from that what are the other expenses, like lawyers, etc...

Actually, that's just the cost to file the case. If either side needs to hire a lawyer or expert to research relevant case history decisions or trademarks of the case, you could pay another couple times that amount in attorney fees.

If you are on the defending end of it, don't think the extra fees will be taken into consideration on buying vs. filing, since most big companies either have lawyers on staff or have them on retainer and figure they'll pay that cost either way. Some might even prefer to spend the extra money to get the publicity and reputation of protecting their TM in order to discourage others.

First of all lawyer's expenses are always payable. That is filing Court Actions, Filing Registrations, photocopying, letter writing, telephone calls they are always billed by the minute. Lawyers keeps what a called dockets and anytime you speak to them they put down the amoutn of time spent on the phone with you or with anyone else with respect to your case. So besides the actuall expenditures of filings you also have the lawyer's time added to it. Also if they have to get others involved their time also gets added to it.

So basically what I'm saying is the cost of the filings and however much time is spent is something that no one can count on because it depends how far and how deep you want to take this action.

Indeed - I was merely giving the "best/worst" case scenario for the OP - and since his original claim was $1,000, I thought it best to disabuse him of that notion. And I labeled the above as the cost to "file", which a layperson can do, thereby costing right around the above (Of course not taking into account incidental costs, etc.).

The above information was posted so as to be straight from the horse's mouth, instead of thrice repeated hearsay ;)
