TM issue for my .mobi

Do you know much about TM's? I registered safemode.mobi,there is an australian company that has lodged a TM,it's current status is 'under examination',acceptance is due on 12 june 2008??

If it has not been approved yet then do I stand a chance?

they have lodged with ipaustralia.gov.au

Depends.. can they prove "bad faith"? when was first use? When was the domain registered?

It seems it could be generic, but there are many TM generics, it all depends on how it is used.

well they are computer services company

they put an application in last Dec 2006,i only just registered now LOL

SAFE MODE is aterm used by MS and apple within their OS,So very confusing

You didn't mention how it is being used. If you are using it in another catagory other than the TM, you should ahve a shot in keeping it. If you already crossed that line or offered the domain for sale to the TM holder, that is not too good for you.
