My apologies for the drawn out story but it helps paint the picture for this dispute.
I have a family friend, Max, who is starting an agricultural business offering a unique soil treatment product. He had registered the .com domain name of the future business and had enlisted the services of a friend to help with the website and provided access to the registrar/hosting account for that purpose.
During his efforts to raise many millions in investment capital to set up manufacturing facilities Max had a massive heart attack that resulted in hospitalization for several months. During this time, his friend joined up with other interested parties and started a competing business and also changed the ownership of the domain from Max to himself.
The friend then let the name expire and it has since been picked up (I'm assuming) by a domainer.
Unfortunately I found out about this drama after the fact and could do nothing to help prevent it.
Obviously Max should have never given access to his registrar account but that is water under the bridge now and a serious mistake I am sure he will never make again. Is there any recourse that can be taken via law enforcement and/or ICANN to regain possession of the domain? It was stolen from Max during his personal tragedy and he needs it back to continue his business efforts now that he has regained his health.
