Actually, I believe you can be a member of DNOA without being a part of NP. Ron has been working on separating the databases so that DNOA can be separate enough to get support of other forums. True, it was started by NP members, but the intent was to go beyond this forum. My saying it's separate, is because I am not a moderator or have any power at NP other than being a member, and can't ban a member from here. However, I am on the ethics committee of DNOA. I do have some power with DNOA, and until yesterday, was not aware of this thread or the situation.

My response here is that with nothing filed up to then with DNOA, the ethics committee (at least myself) did not even know about the case. Second, part of the formal procedure is trying to find out what is an acceptable resolution to the case. In this case, follow through with the sale isn't possible according to posts that it sold elsewhere. The complainant needs to document their costs and what the DNOA should ask for on their behalf. I would much prefer to "smarten up" someone acting unethically and have them change, than just ban them and let them keep operating that way under the radar.
BTW, I do appreciate your willingness to "hunt down scammers" without help. Unfortunatly, I don't think bounty hunters make a lot of money in the domain business as their is no "bounty" other than satisfaction

Filing a complaint means you are serious. The ethics committe are volunteers who will help when asked. We are not cops or paid detectives out on the beat searching for trouble to resolve. When asked we will intervene, but I think we do need to be asked so we know the situation was not able to be resolved beforehand.

Okay, "lynch mob" might have been a bad choice of words. However, there are always two sides to a story, and they don't always agree. Personally it sounded to me like a blanket "ban the guy" with no holds barred. I would really rather see wrongs righted than ban someone and the original complainant not get resolved. There also seems to be a general feeling at this point of one strike and your out. I think some thought needs to be done in the future toward this end. Ebay doesn't even ban someone based on one strike unless it's blatant. This user had a good record up to that point. I think he should get a chance to make things right, which may be difficult when a discussion like this get's heated. People do sometimes make mistakes or bad judgement, but that doesn't mean they have a pattern of it or will repeat it. There was another thread warning about a particular user last week. Although cautious with them, I did complete an $1800 sale to them with no problem.
I don't think it's as easy a ban and be done with it. That would be easy, but I'm not sure it would be right.
I understand complaint has been now filed, although I haven't seen it yet. I'm sure the committee and directors of DNOA will make the right decision based on the facts.
