I have a domain name ending in .io that I purchased because the .com was taken and listed for a very high price. There is no trademark, as the .com isn't developed as anything. I intended to develop a site with it, but a year later realize the site isn't going to happen.

I would like to sell it, but figure I should give the .com owner the first option to buy it. Would I get into legal issues here? The person would likely be pissed at me, but I didn't intend to buy with the intent to squat on this... when I came up with the name, I searched and .com was taken. If I had intended to just squat on it for such a purpose, I would have contacted them a year ago.

Tempted to just list it on a domain auction site so as to avoid issues. Any advice?

The .com owner isn't going to care about your .io registration. Do what you want with it

If the owner of the .com or anyone else has not TMed the name or is in business with the name, there there really is no legally issue. (but I'm not a lawyer). There are a ton of .com names where people own a non-.com version.

However the likelihood that the .com owner would buy your domain is slim to none, especially if the domain is not tech related. But it doesn't cost much to try.

As long as the .COM name is not trademarked or infringes any copyright violations , you can always sell it in the open market.
But if you voluntarily approach the .COM owner about your intention of selling this .IO domain , he would quote you very low price (chances are there of getting high price , if he has built a brand around it which is not TRADEMARKED or COPYRIGHTER).
Try your luck with auctions sites for better understanding on the value of your domain.

I had this very thing happen to me...was offered $795.00 but later sold for OVER 100 TIMES that amount.
