Recent DDoS Attacks on Site I Work For

Hello,

I am a moderator/staff member at a well known site that has recently been receiving multiple DDoS attacks from who we believe to be former members who were banned for violating the rules of the website.

A few weeks ago an individual created multiple aliases in an attempt to fraudulently use the system on our site, and was ultimately banned after our Administration Staff caught on. He/she has since created multiple other user names using various IPs in an attempt to defame the website by making false claims about the company in our message boards and chat rooms.

So, this all brings me to my main question: Is it possible to prosecute the individual(s) responsible for the DDoS attacks if they are in the United States? Our website is based in the US and is run on company-owned servers. I have not talked to the Administration Staff yet since they are keeping this tight-lipped, but I'm just curious as to whether or not there is something they can do to prosecute the 'hacker'.

Im certain there is some law that would cover this. Unauthorized access to a system... You banned them and made it clear they were no longer allowed to access the system, yet they continued. DDoS attacks could be considered as theft of services... Theres probably a bunch of other laws that would apply as well.

But you have to be able to prove that the person you think is doing it, is the person who is doing it. That can be tough. And it'll probably be hard enough to find a law enforcement official who understands any of this, let alone expect them to track down the culprit. So unless you have some hard evidence, you probably won't get far.

a DDos attack is indeed a criminal offence but the problem is most DDos attacks are not carried out from the users own computers. The attacks are usually carried out from servers that have been hacked. This of course makes it extremely difficult in getting logs together to prove who was the perpetrator.
