for the domain name xxxx.com, if xxxx is a dictionary word, but "xxxx!" is a live trade mark. How significant is the "!" on the trade mark? What is the risk for the xxxx.com holder?

it would depend on usage ... if the domain is used in the same industry (class) that the TM is registered , or in a manner that could cause consumer confusion or dilution of the mark , the domain could be "at risk" ...
