NP'ers advise guidance needed.

I mostly develop back end code and some mild design work, and sometimes my clients need domains. So, I found this forum very helpful!


My question -
After seeing some domains of interest, I PM'd the thread owner to inquire on the price.

They came back with a price. I counter offered with my own price ~18% lower, and we were not able to meet on the price.

Since, we were not able to meet on price, I asked about another set of domains that I also liked, some were expiring sooner.

But, the domain owner expects me to complete the purchase of the first set, and has cited site rules and called it a transaction. I looked but didn't see any rules on this - I was wondering if this is something I must buy definitely, before I consider other domains - it seems a bit odd to me.

Can some guru advise me please,
  • Am I required to buy the first set
  • how do you go about offering a price or finding out the price - if there are no BINS listed
. Feels like I am walking on eggshells :notme:

If you did not agree on a selling price then there is no obligation to buy or sell the names. I see no reason why negotiations cannot proceed on a different set of names.

As far as names with no BIN...a simple offer, counter offer scenario should suffice.

In my experience, negotiations made through PM are more informal that what goes on in the sales and auction threads. Those areas of the site have their own rules (no off-topic posts in sales threads, etc.), but PMs are just private discussions between you and the seller.

It sounds like you contacted them about names that were "make offer," so it's at their discretion whether they want to meet your price or not. I'd give it some time because sometimes people are busy and can't get back to you right away.

You didn't do anything wrong, and you're not obligated to buy any set set of names before others. It sounds like he/she is just trying to sell those particular names first, and push you towards a deal.

Thanks for the advice, I was talking to another NP'er - he said, you don't want offend people, but you also don't want to over pay. So he suggested, I ask/PM them where they're on what they expect - if its out of our budget, then move on - if its close, make an offer.

Offer and Acceptance are 2 eseential elements to a contract..

Did he accept your offer?

in my opinion, if you made an inquiry and $ offer, but the seller declined, your obligation ends there. don't feel pressured into concluding a deal if your offer was rejected. even if the seller later decides to accept an offer you made that they already declined, you are not obligated.... again that is only my perspective but in my eyes makes sense. comes down to the clarity of offered and accepted/rejected i guess.

If anyone ever runs into something like this, which is unreasonable when no price has been agreed upon, is to ask the seller to show you the rules on the site. This will remove the uncertainty.

It sounds like perhaps there was some mis-communication where you said something in a way that the seller thought was an acceptance of his original offer like "I will pay your price if you lower it by 18%". There are MANY members here who do not have a good understanding of English, and sometimes customs are different. Sometimes they are just sleezy, but that is generally not the case. You get all types. :)

If he complains that you are breaking the rules, contact a moderator and show him the messages and get them to help. If someone is trying to push you into buying something you don't want, I think that would be breaking a rule for sure.

It will help you to know if his asking price is reasonable or high. Being new here that may not be easy.

Lastly, I have been trying to work with designers and developers to supply domains to clients. I'm sure that many of us here would be interested in doing that, but not all would offer a 50% discount. When you are looking for domains, you can act as the broker and make a nice commission for yourself that way of 10%-30% I think. I pay more because I have more domains to sell. :)

Thanks for explaining NP'ers. I used your suggestions : :kickass:

  • We finally arrived at a deal.
  • I sent payment through paypal, and asked where the domains were parked. (Since he removed it out of his thread listing and I couldn't tell)
  • He said he wants to do business in the future.
  • Next thing you know, he is refunding the money and canceling the deal.

I hope that makes better sense
