Possible to take a webhost to court?

obviously i can't. I currently run/ran a webserver with a friend, it was in his mums name. i worked very hard on several things and didn't get to back up things for today and got offered money for a site of mine. Anyway i go to upload some new files and back-up the server when i couldn't access ANY site on the server, i was like oh the server must be down, it didn't bother me then i got annoyed after many hours i got frustrated so i logged onto the site and went to support. all admins were on. i begun talking to the server tech. he was puzzled then said "you haven't paid your hosting bill" then i begun telling him it was paid for the year under a special deal and stated details and even backed up my statements with evidence and now the server tech is like, you have been mistaken even tho it was a deal the owner had and his saying they'll give us a refund instead of giving us the 10-11 months owed to us.
Wouldn't that come under breaking our agreement?

I become quite annoyed with this then i messaged the owner asking him what was going on, he was promising it would be up within 24hours and such.
i'm not really sure if i have any grounds to do anything but this is really pissing me off. The server was a major source of income for several people.

If the 24hours are up and the server isn't up, what should i do? i don't/can't demand a refund because it'll hurt myself, the other part owner & clients.

I need some advice here.

Bump.
sorry for the bump but i need some serious help. Everyones losing money, everyones getting angry and my host provider who supples the dedicated server has broken our agreement yet again and has hidden. this is really getting on my nerves. i need help. anyone got any advice?

I'm sure you don't need me to tell you your priorities. But let me ask you what
is more urgently important: getting the site up ASAP or holding the host liable?

Deal with what you think is the more easily solvable problem, then handle the
other when you're done. Good luck.

Yep, agreed. Your clients/user come first. Get your files out or use a backup that i hope you have stored locally. Move to a different host, get everything back up and running, then unleash the hounds. Understandably you're pissed, who wouldn't be, but prioritize and focus!

Go to Webhostingtalk.com and search for good webhosts. Ask around there first.

Can you name here or if not, PM me the name of the data center/webhost so we/i could avoid that in the future?
