Domains for sale - PMd offers and obligations

Hi,

If a buyer PMs an offer, and the seller PMs back an acceptance, does that create any obligations here on NP?

e.g.

Is the buyer obligated to complete purchase?

Is the seller obligated to hold the domains for the buyer? If so, for how long?

Is it commonplace for buyers to make offers and then disappear? Just part of the trade, get used to it, or is it grounds for negative trader feedback?

Thx

The views expressed on this page by users and staff are their own, not those of NamePros.

It's a private one-on-one negotiation, of course ... but professional standards should be adhered to at all times, public or private IMHO. :gl:

It may be best to organize the PM chronology and formulate a logical, sequential case as to what you believe may be the injustice - and then document and communicate that to Staff™ for their thoughts and assistance (this should be after attempting reasonable resolution between yourself and the other party)! :talk:

Often times miscommunications can occur ... with no signs of intent! :red:
Deals that are affected privately via PM's cannot, and should not, be obligated by the site or its Staff™, naturally.
Just from my experience and two sense.

Yes of course. A contract is formed at that point and both parties should be obligated to follow through unless they come to a mutual understanding to do otherwise.

This is a gray area, and really depends on the correspondence. If a time period is not discussed, the seller should give the buyer a reasonable amount of time to make payment, and the buyer should pay promptly. If you do not receive payment, and all attempts to contact the buyer fail then you wouldn't be obligated to hold the domains forever.

No, it's not commonplace. That's bad business and definitely grounds for negative feedback and quite possibly a ban from our site. Just make sure you've given fair time and opportunity for him to respond.

Before it gets to that point, you can contact a member of NP Management to see if we can reach the non-responsive party. Sometimes there are valid reasons for a delay.

Thanks Jeff and -RJ-, it's good to know what the expected behaviour is.

It has been four days since I received the offer, (and 2 days since the offerer said he would pay in 2 hours). I have PMd the offerer again today asking for confirmation of intent.

I figure after one week has passed, I will send details of the communications to management and then follow their advice / decisions.

I doubt NP management would ban you without making contact and trying to get your side of the story first, but I guess I should let them speak to that.
