Hi All,

I have a new idea that is sure to be a success. The idea is new so we will go for patenting too. For your informaiton idea is in the field of semantic marketing which is not practiced now.

I want a creative technical partner for development and advice. The person should have knowledge of web technologies (PHP, java script etc.), database (mySQL etc.), web desinging.

I know this idea would be generating lots of money, but i don't want people to be attracted because of the money. People who are interested in working in creative things should come forward.

I have a couple of questions:

1. How much research have you done into the idea? (How sure are you, that if someone else did a bit of research that they wouldn't find your idea already being done, and would you be willing to bet that there is nothing else like that?)
2. Are you aware that you cannot actually patent an idea, and that you can only patent a process? (This means that you can't patent the idea of the website/software and only the way in which you made it)
3. Are you aware as to the costs of getting a patent?

Patenting idea

Let me answer your queries one by one:

1. A prior art search has already been completed for major patent databases( US, EP, JP, GB etc.). The search was conducted on Delphion which is a paid database. Since the search was exhaustive so it is probable that the concept can be patented.

2. Yes definately we cannot patent an idea but we can patent a method. "you can't patent the idea of the website/software" I guess you didn't got my concept- i'm not patenting a website. I am patenting a method which will be implemented by us and website is just an interface for the users.
For your information software can be very well patented, uspto allows software patents, EU allows sofware patents if it has been clearly enabled. I think you must be talking about GB.

3. Yes i'm definately aware of the cost required in patenting. Tahts why we will first go for a PCT filing so that we get a priority in all the member countries and get a 1 year extension date. In the mean time we will launch it over the net and gather enough money to file the patent in individual countries.
