my host, LowestHosting.com.. has gone to crap. they have been ignoring my emails and have further restricted my bandwidth (I signed up for and paid for unlimited bandwidth per their offer) and therefore cut my visitors by 90% in two weeks.

I am about to send out this email (they are located about 100 miles from me) and need to verify if I am in the right here and am proceeding in a fair and just manner:

Hi,

Seeing as I am being left with no alternatives as I have not received replies to the last 3 e-mails I have sent this will be the last opportunity for LowestHosting.com to resolve this outside of the Lane County, Oregon Courts.

I am willing to work on this situation however. While I feel that I am being more than compliant in lowering my bandwidth to aid LowestHosting.com, I am not obligated to do so as per our contract. I am still willing to do this but need the throttle placed in a different location as to allow my site to still be visible while lowering the bandwidth used on the site.

I have enjoyed working with LowestHosting.com up until the past two weeks when the E-Mails stopped and apparently LowestHosting.com began to ignore any attempts by me to aid in this situation (although, legally I have no obligation to do so).

If the throttle is not placed into the "Uploader" directory to limit that portion, then I demand that it be removed entirely. I regret having to allow this complication come to this point, but feel I am being ignored by LowestHosting.com and that my interests and those of my site, FXClips.com are being ignored.

LowestHosting.com formally has until 8a.m. PST, February 5th 2004 to remove the throttle or failing the removal, by proxy aknowledges it is in violation of our contract and therefore liable for all losses incurred between Jan 17, 2004 and until the date at which our Bandwidth is restored, the throttle removed and our visitor base has returned to its numbers prior to the debilitating practices employed by LowestHosting.com.

Anybody that signs up to a host offering 'unlimited' bandwidth should be known to have problems. There is no such thing as unlimited bandwidth.

Isn't there a phone number you could try contacing them by?

I do not see a need for me to pay for the LD for their issues in their contract (though I have thought about it.).

I'de advise you back up your site.. and find a new host.

They want you out. Just leave.
They most likely will not honor your request
and will wait to see what you can or are willing to do.

Either way it is over and you need to get looking for
something new..and I am sure that will not be an easy task
considering how much you are probably paying right now.

I believe a more reasonable request would be to negotiate
a business solution together. Eventhough you know you are in the right and would hate to admit defeat - admit you'd like to stay
and would like to continue to work with them to improve our bandwidth/diskspace issues. "Lets resolve this through negotiation I really enjoy your service and would hate to leave"
I have had issues in the past about business and have written many letters like the above and it is just not effective. From what I have found out anyway.

If they really make you angry just leave hosts and call your credit card company and request a chargback for the month. I know it is mean but in reality your not getting what you paid for and there is nothing they can do + you get the last word.

Good Luck.

well the hosting is paid up until July. So I would want that money back.

What are my chances of that happening?

hmm Wanda... their largest package.. 25.5gigs/month..

I do more than that in a day :(

Identity,

I have been trying to negotiate service with them..extensively. it has been nothing but me bending over to help them because I do understand their position...

however, now that I have been getting no reply from them... and having them so close to me ... Im thinking of just suing... Being in Oregon (both of us), it makes it easy... but a last resort...

I have so much time invested here with these negotiations that I shouldnt have to be doing....

maybe suing for false advertising...

no..but I just did (thanks).

I was looking at over a tb of bandwidth last month (before they got gestapo on me)....

pair.com doesnt offer that much, but even if they did it would be too prohibitivly expensive...

*sigh*

maybe If I bought a server... how much is the connection for something like that?

Lee, a few thoughts and ideas here.

Bottom line is someone, somewhere will have to pay for the bandwidth you have gotten up to. Ask them how much they want to keep servicing your account. Figure out how much bandwidth you will need and shop around for someone to provide that.

Check out server prices and bandwidth at some place like http://symplexity.net/dedicated.htm or others I am sure do this kind of thing.

If you hook up with another unlimited bandwidth outfit, the same bill will come due later so might as well face it now.

Check with other sites that use a lot of bandwidth and see who they are using. A quick email could not hurt, and they may even have space resources available on their servers. Other clip sort of outfits may have already solved the problem you are now facing, so you donโ€™t have to re-invent the wheel.

Your current host has no incentive to perform as they are probably loosing money on the deal. You will waste time and money trying to get them to come back to life.

The solution will come to you. Remember the bear will find you first if you smell like honey. Good luck.

Advise well worth 2 cents here: LOL

The threat to sue is good, though in actuality its probably not worth your time.

After finding a new host and moving your site, the best thing you can do is submit a chargeback request with your credit card company, or put in a dispute with PayPal.

Stay away from unlimited bandwidth hosts (its just a marketing ploy) and consider a dedicated server if your requirements dictate such.

like other ppl say get out, I went through the same thing with 1t3 and ended up forking a years payment for 2 weeks. Its not worth the lawsuit because youll end up spending more then you will get back.
