Nuke.com and Nike.com Similar Question

I am looking to purchase a name very similar to this one i am going to use for an example

nuke.com which is a typo of say NIKE.com
But it also has other meanings as well. would i get in trouble for haveing PPC on that page if shoes or nike type products showed up?
Also what would you say the value of a LLLL.com similar to nuke.com thats a word, is easily promnouncable, has meaning, and about 10Million google results?

Also i think it could have other marketing and branding possibilites given it is a non TM generic LLLL


Nuke and Nike are not the domains in question but its a very similar situation.
Your insight would be much appreciated in its value.

Yes if you put a ppc on your example and nike found out they would probably do something about it claiming that the domain name was confusingly similar to they trademark and that you were gaining financially from that.

I would agree with that opinion. Those big companies have lots of highly paid lawyers!!! I like to stay as far away from them as possible.

Well, it really depends on what you do with the domain. Going with your example, if you started advertising running shoes on Nuke.com, then yes you're inviting trouble. If there was a legitimate use for Nuke.com that was unrelated to Nike, then no problem.

Similarity to a trademark is only one of the three things a trademark holder has to prove to take a domain away from a domain owner. The others are no legitimate rights and bad faith.

I agree, there should'nt be a problem if you are using it for nothing similar/related to their product but if you are gaining financially from their name then you could well be in trouble.

That does'nt seem to stop alot of people though ! I have seen many examples of domainers doing this.

To get the best of both I would put completely different subject material on 'nuke' but then exploit the typo by offering the other domain holders (i.e. nike) advertising space on the site- if they were smart they would realise the amount of traffic you would send their way and you wouldn't infringe trademark. (I must state I have no experience of this scenario it is just an idea I would explore if I were in this situation).

I agree 100% on what you are saying but couldn't putting ppc advertising as the main content on the site be considered bad faith. And the fact you have no proper content could indicate that you have no legitimate use for the domain.

very true.. seems like some companies care about it and some enjoy it. LOL
well the name im looking at is not nuke.com but that was just the close example.

If the content of the site was completely unrelated to them, and the domain was also a completely different recognised term, surely the typo traffic that they are losing could be recognised without having to give up the domain? I'll bet if you were to offer the space to their competitors alternatively they would be only too happy to oblige, or in the above example, a sports retailer's ads, for example, would surely convert even though the content of the site may have nothing to do with what is being advertised?
