No Trademark, but possible conflict?

Good morning folks.

I registered a domain in June of this year.
Googled the name (without .com) and it came up with several results, one of which was a company or organization in Mexico with the name associated with their project.

Contacted them (week, week and half ago?) through their "Contact Us" page and informed them I registered the name and asked if they were the previous owners. Still have not heard back from them.

Did a search through the USPTO's sections of trademarks and copywrie sections and came up with no reports.

I'm thinking about branding the name or even selling it.
Do you think there could be any conflict or legal action in this?

As long as it is not a trademark violation you shouldn't face any problem. Check if they hold trademark in Mexico or other country where it exists. If it does then you can potentially still face UDRP for the domain name.

You should be OK, but to be extra safe make sure you don't park it or try to sell it to them. Parking it can be seen as trading on their name to earn an income.

Looks like you have to pay for their searches.

No, I decided not to park this name or list it on auctions.
I have, however, submitted iit for branding.

This name or company could have whats called common law rights. These rights, or common law trademark rights as they are known to lawyers, come from the continuous prior use of a mark in commerce. Common law rights, when recognized, will protect a mark holder as against infringement only within that specific geographical market.

Yeah, I just may go ahead and pull iit for now until I check into the iInternational laws with this.
