I recently acquired a .com domain and have developped it into a small site. Today, I received an email from a UK company claiming that they have trademark of my domain and ask me to transfer my name to them. I did a search on www.uspto.gov but find nothing. It seems that they only registered the trademark in UK and don't have an international trademark. In a situation like this, is it easy for me to win a ICANN dispute? has anyone here experienced the same situation before?

Thanks a lot!!

I'm afraid it's a complicated subject - but chances are they are full of BS and just want the name.

I do know of some domains that have a TM but are being used for a different purpose completely.

GulfAir.com is one of them - the airlines called Gulf Air have the TM but the domain name www.gulfair.com is being used to sell air freshners ??

I would of thought that if they could of legally got the name they would have ? Gulfair.com gets an overture result of 774 with extension - I don't imagine people are actually looking for air freshners :-/ I could be wrong.

I suggest you consult a proper TM lawyer if you feel the domain is valuable.
It's probably an attempt at "reverse Hi jacking" and they are trying to scare you.

I think you are probably safe unless they can prove bad faith against you. However, try posting in the legal disputes forum. JBerryHill and a few other members may be able to give more feedback on your situation.
