dear every body,


i bought a domain from some one 1 month ago, he transfered the domain

from his network solutions account to my godaddy account. i recieved the

domain and renewd it for 6 years in advance.


he received his money cash in hand with out any problem. until now

every body is happy.


the problem is as follow:

i logged in to my godaddy account yesterday, i found all my domains

there axcept the domain i bought from the guy, it disappeared. i ran directly

to the who is service to see that the domain is still under my name. and

even the email which i use under that domain is still working, sending

and receiving emails with out any problem.


it looked like a weird problem, because if it was transferred away i would

receive an email at least so i would be alerted.


any how, i called godaddy customer service ... and they said that i have to

contact undo department regarding this particular domain.


i did what they told me to do ... i sent an email to [email protected]


explaining the problem of disappearance of one of my domains.



they replied me that the previous owner of the domain disputed the transfer

thus the domain now is not active and locked untill the investigation is

completed. ( but am not sure locked by who, network solutions or godaddy)




i sent an email back to undo department explaining to them that i bought

the domain from the previous owner and the transfer was 100% legal.








now i want an opinion from the experts who have familiarity in such

instances.



who you think would keep the domain ? me or him ?

if the transfer is legal would he be able to get the domain back ?



any opinions ? on what shall i do ?


am afraid that am gonna lose both, because he looks like a scammer.

Heck, why not contact the place you met and see if you can get security camera video... if need be, contact local police on the 'scam' and use their tools to help catch the guy...

Even if the transfer from the seller to you was 100% legit, the seller may have been, perhaps unknowingly, in possession of a "stolen" domain.

If "stolen", the transfer of the domain from the seller to you doesn't change that - the rightful owner, in many instances, regardless of numerous transfers in the interrim, would still have the right to get it back.

You mention meeting the seller in person - hopefully you know who the seller is and can get your money back. If the domain is determined to be "stolen", the seller is obligated to refund your money in full.

With all that said, you mention the sellers phone no longer working - that's a bad sign.

recluse99 is spot on - contact the local police and/or hire an attorney to get a subpoena for a copy of the security camera video. And since the transaction took place face to face, the local police, especially if the amount is in the thousands, will likely be helpful.

Who keeps the domain would be depending on what the undo dept finds. I'd definitely send then a copy of the sales contract, even if they haven't asked for it.

I assume you have the sellers address? Then I'd go round to his home immediately and ask him why he is disputing the transfer.

Perhaps, but from my understanding, the decision is, for all practical purposes, up to the "losing" registrar - if they (Network Solutions) believe it's "stolen", GoDaddy will transfer it back and let the "losing" registrar deal with the matter.

A written sales contract is often meaningless in regards to retaining "stolen" property.

However, such a contract, depending on how it's drafted, can be helpful for a buyer to get a refund from the seller.

i called the guy today and i found him .... i just asked him why he disputed the

transfer after he sold the domain ... ? guess what was the answer :)



he just said that some one offered him 30% higher price ... and he is sorry

for the dispute .. but business is business .... and he is willing to pay me back the

amount i payed him ...



but folks, do you think this is fair ? ...


the seller of a domain can just change his mind and submit a dispute ?

with no rights that can protect the buyer ?


this is the first time i buy a domain ... and am shocked about the whole thing

specially that the buyer cant do anything :)

You should be communicating that conversation to the undo dept also. Sounds like blackmail to me. Report him to your police.

Try to find out if the seller is a longtime forum user here and/or on DNF.

If so, make clear you will reveal who they are publicly (after you double-check their info privately with some regulars here), if they don't follow-through on the deal as agreed.

Personally, my suggestion is go with the "safe" choice ... meet up with the person again and get your cash (don't accept anything else; no paypal, no checks, etc) back in full and move on.

contacting the cops is bad advice and will not resolve anything but make you look fooloish.
this is a civil matter.

I agree with Ron. Do your best to get your money back and walk away and take it as a lesson learned.
I hope that cat never gets a chance to do business with anyone, ever again. Deal is a deal.

You say you logged in to YOUR GoDaddy Account from HIS computer?
He could just have had a keylogger in his PC, traced your password, and framed it as "Stolen"

Good Luck getting your domain back!

no buddy :) am not dump to the extend where i will log in from

his computer .... i logged in from my personal notebook ..

and hewas setting beside me with his own notebook as well ...

anyways.....business is business and you have a written contract, file a civil law suit, let him pay the charges, good luck!

My crude advice is to not be a b**ch in this matter and tell him you will file a civil suit. Remind him thats it's only business as he once told you. Also, he is running the risk of being more liable than the price of the domain.

You need to understand that you call the shots in this situation; not him. Make that extra 30% he was after a lesson for him and others like him.


PS A packet sniffer would have done the job, but that doesn't apply here - The guy admitted he was offered 30%+




well buddy, am still waiting fro godaddy undo department to reply me

i explained to them that the transfer was legitimate and they even

realized that from looking at my account records ... and i hope they

would be fair with me ....


if they do ... ( hopefully they will )


no need to offer him the extra 30% ...and i will keep the domain ...


in addition, this would be a good lesson on how to deal with such situation

not only for me ..but also the result would be a good knowledge addition

to any one who read this thread ...

well am not gonna make any move untill i get a reply from godaddy ...

law suite would be the last thing to do :)

I hope you conveyed the information to godaddy that he disseminated to you about receiving another offer... that should nullify his attempt to get the name back.

Its shady at best, criminal at worst what he did. Filing a false complaint is, afaik, criminal in most if not all jurisdictions. Did you get that statement in writing or on the phone? If writing, send a copy of it to Godaddy!

Good luck... this guy is a sheister... this isn't 'business'... he is trying to rip you off. If you go buy a car for $10,000 and the next day someone offers him $11,000... that doesn't give him the right to come take the car back to sell it to another player... thats not how it works. He is a scam artist :(

hey every one,


i am here today to update you with the last portion of the story :)



in fact i was waiting for the results of the investigation team of godaddy.

i didnt get any reply in a matter of fact ... i was stunned to see the domain

appearing in my domains list under my account again :) am very happy for this.



i am pleased and satisfied ... and godaddy proved that they are the number 1

registrar by all means :)




but the question now ..... can the seller file another dispute again ?

i hope he cant :)

He could. And he might be ignored.

Just be ready for that possibility, however irritating it is.

My head tells me to move the domain... maybe someone else can comment ... could that hurt the op to move the domain to another registrar? Seems it would be safer so Godaddy can't just pull it away again.
