Microsoft Sues Dentist For Cybersquatting


Microsoft has filed a trademark infringement suit against a California dentist who has registered more than 40 Internet domains with names similar to the software maker's products or brands.
The domains registered by Dr. Saed Said are "identical or confusingly similar" to Microsoft's trademarks, the company claims in court papers filed in U.S. District Court in Northern California. The domain names registered by Said include aMicrosoftShop.com, aMicrosoftStore.com, XboxOutlet.info, and XboxMarket.mobi.

Microsoft claims Said operates the domains in a deliberate attempt to confuse Web surfers looking for the company's products. "The person has been diverted from the Microsoft Web site he or she was seeking to visit, and Microsoft has lost the opportunity to interact with that person," the company claims in the lawsuit, which was filed in August.

Nice. I remember awhile back, they sued a guy named Mike Rowe because he owned MikeRoweSoft.com and didn't sell software. If they won that one, they will have no problem with this one.

Oh, they settled that one if you search online about that. It was a bad thing
that turned into a win-win for all parties concerned.

I think Mike Rowe even won a Xbox (lol). But remember that that case was different. It was a teenager, and it would not be good for Microsof's public image to sue him.

a remember a few year back my uncle got a ceast and decist (sp?) for his domain AOLTravel.com. He's a travel agent and tried to push it off as Alfonso Online Travel.
Long story short, he removed the content!

not even good names...what an idiot. reg subpar cybersquatting names, then get sued and probably lose a lot of money.

Should stick to what he knows, there is good money in dental practice I'm sure ;)

Thats right he also got a tour of the Redmond Facility if I remember correctly.

I would like to see any argument that the dentist comes out with to claim legitimate use. They are 100% blatant trademark infringements and he deserves everything that he gets.

I'm writing to you in reply to your lawsuit regarding my trademark infringing domains. I must tip my cap to you as I have found your lawsuit to be quite biting, and upon further review I have determined it has a lot of teeth to it. I don't know if there is much wisdom in me trying to keep the domains in question as you will probably be successful in extracting them from my domain portfolio. I had hoped to bridge the gap between our sides, but I believe fighting this lawsuit would probably leave an enormous cavity in my personal finances (in fact, I may end up as an indentured servant to you), though if my oral arguments were to achieve a win... there are enough anti-Microsoft people out there that I might receive a plaque, possibly even a crown. To get to the root of my decision, I have decided to let you take possession of the domains in question. Though I don't want to give you the brush off and I hope I don't strike a nerve, I have to say that this situation has caused a great deal of decay in my personal relationship with your company and I will no longer buy any of your products.

Well now Microsoft and Dell (with others) are going after several "registrars".

iholdings.com was the registrant of DotRegistrar.com, and many connections have been made. Wonder why they or Dotster are not named in the suit? My guess is that they are looking for settlement dollars, if they are in fact connected. They can avoid dragging their names through the mud that way.

Kind of like Oversee.net and all their Holdings companies...Chesterton Holdings, Jucco Holdings, etc and picking up domains right after they have been quiered. ICANN supposedly investigated it, but even though it was obvious, nothing happened.

And just like that, nothing will happen with this suit...except a decent settlement, and this news will all just slip away.
