How can Nitendo can trademark a name like MARIO ? I cannot beleive it. Then, they regged MARIO.MOBI

It should not be allowed to regg a name like MARIO, PETER, JAMES, JOHN, etc !!! They should have a lot money to succeed registrating MARIO. Unbeleivable.

I accept they can regged MARIO BROS, but not MARIO alone.
Any comments ?

Hey People,
It sort of depends on the type of registration as to whether a trademark can be or will be issued. If you look at www.mario.com, this registration belongs to a software company in which the owner's name is Mario. In this case, Nintendo cannot impose a trademark infringement since the individual's name and business reflects the domain registration.

However.........

Since this website has no content on it as of 4/17/2007, depending on the circumstances, Nintendo could open a court challenge for this domain if the individual cannot show that his business or operations is not actively using the domain or site.

Just a thought.

Why do you care so much?

If you have a website or company named Mario and have development plans for it then maybe you can try getting the name back. Otherwise why does it matter? I'm actually happy nintendo owns it.

I really do not think so.

There is no requirement that a domain be in use, only that it not be registered in "bad faith". A non-competing website is evidence of good faith, as is having the name Mario, but that is not the standard. If Mr. Mario started selling video games in competition with Ninetendo then he could lose his domain, despite his name.

Of course nothing is keeping Nintendo from trying to bully it away from him regardless of the standards.

That's pretty amazing they got a TM on such a common, person name. I too could understand TM'ing "mario brothers", but not mario alone that seems bs to me altogether.
