If JohnMccain.com or
hillaryClinton.com was open foer registration while they were serving in a public elected office can I register it? My understanding is poloticians dont have a TM on there names is this correct? Reason I ask is I am running in an election, I have my name but the guy I am running against (he dosent know I am running Im filing next week at the deadline) let his name drop because he thought he was running unopposed. can i REG IT?

Regging peoples names (especially famous/important people) carries similar risks to regging a TM (or so I believe). If you did reg it, it is highly likely to be seen as unethical as you are running against the person.

People wonder why politicians are never trusted... Why would you do that?

Anyway, to answer your question in part, politicians are not viewed as TMs in genereal, but many people who become politicians can be afforded TM protection because of other careers they may of had. Hillary is an author and paid apeaker, Arnold is an actor, Sony was a singer/entertainer, Mary Carey was a...(well, she didn't win, but it makes for comic relief in this post). Their names could viewed as TMs because their names are used in commerce.

why would I register the name? He is an incumbent and his domain is listed on the city goverment website and I used domain privacy and someone else has the .org and is using it as info on the state I live in and I am quite sure it gets traffic and I am going to repoint it to my campaign website and get his traffic maybe.

Cant find anything commercial about him he is a retired school teacher
