Is it proper to sell your expired domains?

I have been selling a bunch of my first regs, trying to recoup some of my costs. Some of these names have just expired in the last couple days. It seems that I retain the exclusive option to renew them for awhile, and that during that period no one else can reg them. So here's my question...

I know I don't "own" them anymore, but do I have the right (legal? ethical?) to continue offering these names for sale - while I retain the exclusive right to renew them? If I don't have the right to sell them, why does TDNAM, Snap, Pool, and Namejet have it? Aren't they doing the same thing?

If I sell an expired domain (assuming the answer above is "yes I have the right"), will I be able to push/transfer it to the new owner without first renewing it?

I recently transferred to Godaddy one of my domains that expired at enom. I didn't think I could do it (enom told me I couldn't) but I tried anyway (because it was a .tv and I pay 19.99 for .tv renewals at GD vs. 49.99 at enom ~ sidepoint) and it worked. So apparently it can be done - but maybe this was a fluke.

i guess you can, but the smarter way to have done it would be to try and sell them prior to expiry so it doesn't cost you as much.

For sure selling them beforehand is better. But what does it cost to sell them after expiration?

well you'd have to pay the redemption fee which is... $80 i think?

Unless I'm mistaken (a distinct possibility) the redemption period follows the grace period. During the grace period it's standard renewal fees.

I'm not sure about how they are called (redemption period...etc.) but it depends from Registrar to registrar.
An example would be Godaddy -> If your domain expire lets say 2008-11-01 then you can still renew it some days (18 ?). So they are expired ... but not really. After that you can renew it, but + 80$ (<- that fee is different on Registrars).

-> About your first question: "No-one own domains, they all are leased / services".
-> About (legal? ethical?) ... I think Verisign / ICANN offer that period for YOU and not for Registrars (like Namejet / Networksolutions) !!! to renew domain
-> On one side you use something you havent paid, but on other side its standard ... which is implemented in whole domain system. I think its ok

-> No, after domain is expired you CAN'T transfer it (not sure about push), so you have to renew it.

... to come to end, i would not matter about legal/ethical

"Upon denying a transfer request for any of the following reasons, the Registrar of Record must provide the Registered Name Holder and the potential Gaining Registrar with the reason for denial. The Registrar of Record may deny a transfer request only in the following specific instances:

1. Evidence of fraud
2. UDRP action
3. Court order by a court of competent jurisdiction
4. Reasonable dispute over the identity of the Registered Name Holder or Administrative Contact
5. No payment for previous registration period (including credit card charge-backs) if the domain name is past its expiration date or for previous or current registration periods if the domain name has not yet expired. In all such cases, however, the domain name must be put into "Registrar Hold" status by the Registrar of Record prior to the denial of transfer.
6. Express written objection to the transfer from the Transfer Contact. (e.g. - email, fax, paper document or other processes by which the Transfer Contact has expressly and voluntarily objected through opt-in means)
7. A domain name was already in “lock status” provided that the Registrar provides a readily accessible and reasonable means for the Registered Name Holder to remove the lock status.
8. A domain name is in the first 60 days of an initial registration period.
9. A domain name is within 60 days (or a lesser period to be determined) after being transferred (apart from being transferred back to the original Registrar in cases where both Registrars so agree and/or where a decision in the dispute resolution process so directs)."

Nothing wrong with trying to sell them still. I sold a domain earlier this year which was in the redemption period -- paid the redemption fee and that was that.

Great feedback zoki and Reece. Much appreciated!

Seems that it's fine to sell them but - since these are mostly very low end domains - I'll need to know if I can push them without renewing first and also how long I have until "redemption" prices kick in. Wouldn't want to sell a domain for $2 that cost me $8 or $80 to push.

Most of the domains are at name.com. I just emailed support these questions so hopefully they will clear it up.

you will need to renew to push the domain. as for when redemption kicks in, its different from registrar to registrar. I'm not familuar with name.com but im sure they will tell you.

I just looked through Name.com's Glossary (here: http://www.name.com/glossary.php ), Redemption is $120 and quote: "If (approximately) 15-30 days after the Expiration Date an expired domain registration is not renewed, the domain name will be deleted from our database and from the Domain Name System (DNS), terminating the domain record and the functionality of the domain name's corresponding web site and email service. After deletion, the domain name enters a 30-day Redemption Period in which the domain is held by the registry and the domain's web site and email are unavailable for use. Once the Redemption Period ends, the domain becomes available again for registration on a first come, first served basis."
