Yes. Not illegal in the "you will go to jail" sense, but illegal in the "they can take your domain" sense.

There are currently no laws saying what domain names can registered and
what can't be. But there are laws somewhat limiting their usage.

Big TLDs as Dave said have no censorship (which i approve)
You register whatever you want and if someone has any legal issue you deal with it

Regional ccTLDs on the other hand censor anything they see or believe must be a reserved word.

If for example the reviewer knows a company of his cousin that has the same name as the domain you register may cut that name .... funny but true
There are many unprofessional ccTLD registry operators out there

sedo will not let you park a obvious TM names. You can test your name at sedo to see if it were a "obvious illegal" one.

sedo does post TM names

Sedo has 210 domains for sale using "Harley-Davidson". Similarly they have many hundreds more like these. I know they made an announcement that they would discontinue this, but not so.

So simply having a registered name isn't the problem as much as using it to syphon off traffic from the TM holder or making money off their name somehow.

And if the company wants it, they will get it, they just usually aren't interested in pursuing it.
