Someone has registered the .org for my company name using the domain registar internetbs.net
It is an obvious trademark violation. How do I go about getting the .org domain name back?

I agree, a C&D or even approaching them would be a much better option, perhaps they don't realize they are violating anything or would be willing to listen saving you both a lot of time and money.

.org is used mostly for non profit organizations - maybe they want to raise funds for your company!

A simple email would be the best step to take to inform them about the TM. If they fail to delete the domain name, then a letter from a Lawyer would do it!

The person lives in Malaysia and is writing hurtful things about my company.
I asked my lawyer and he said besides sending a C&D we can file with either WIPO or NAF (National Arbitration Forum).

WIPO charges $1500, and NAF charges $1300. Both now offer electronic filing (as of last month).

is what he is writing libelous? i.e. provably false?

Before you start spending thousands of dollars on starting a fight, you might try other tactics that would be less likely to piss off the domain holder.

The concept of "Free Speech" is not lost on UDRP panelists, keep that in mind.

What is the domain name? Without that info, you'll not really get much usable feedback I'm afraid.
