Help!

Hi guys,
I have spotted a domain name i like, but the problem is, that the name is tm, BUT it is up for sale, or should i say its at Enom Club Drop thing, so, IF i register this could i be sued? because they hold the tm to the name? or could it just be that the company has gone bust, hence not re-registering it?

But in short, nothing is a given.

Could they seek to get the domain back? Certainly.
Might they have disappeared completely? Likely as well.
