What would happen if I registered GoogleWallet.com before Google announced the Google Wallet, could they come after me for the site if they didn’t like it or wanted it for their own and how strong a case would they have to take the domain from me?

I think this is a dangerous question because Google is a registered trademark and just adding Wallet to it doesn’t really change that, I would like to know what other NameProers thoughts are on this TM issue.

I am pretty sure you would have no case, because Google is a registered TM.

And registered after the announcement, this is a hypothetical question based on the chronology of the registration. Again, what if it was registered before the announcement?

Personally I wouldn't hesitate to reg. it. Small risk, possible big gain. As long as you don't actually use the domain.

It was registered thru YAHOO.

How ironic is that? :o

Perhaps a better example would have been AdobeIllustrator.com, two dictionary words and both are registered trademarks in the US; what if someone registered this domain before Adobe registered Illustrator as a trademark?

Ask the people at Adsense.com how they got away with it. I believe they registered it before Google released the program. Sure, it's not googleadsense.com but AdSense is still TMable.

:imho:-, I wouldn't even take a chance by registering something that is trademarked.

In this example, what if Adobe had been trademarked but Illustrator had yet to be and someone registered AdobeIllustrator.com?

they'd prolly take you down for using Adobe since that is a TM :)

Actually, Adobe might not do anything. There is a member here that regged AdobePhotoshop.(something), parked it, and has not yet gotten into any trouble as far as I know. It really depends on the company. I hear Google is very lenient on domains that contain "google" while other companies won't even send you a C&D letter...they just sue you without warning.

Adobe cannot be TMed, I don't think. It is a dictionary word, afterall. Illustrator cannot me TMed. But, Adobe Illustrator can be TMed, I am sure, since the 2 dictionary words mean nothing together.

Not a good example, because it's not a .com . GoogleWallet.com would be their chosen name if not gwallet.com ....

The .something probably isn't hurting adobe at all, and certainly not enough to make them try to defend it (Costs $$$).

BUT, just because some company hasn't taken action yet, doesn't mean they won't.

Google Wallet... All kinds of Domains available...

Speaking of trademarks, a friend of mine recently registered an incredible name with "Microsoft" in it. It is a very common term and I was shocked to see he got it. Can he expect Bill's sharks to roam around his place soon? I think we have seen how keen they can get with TM issues with the MikeRoweSoft.com case. I still say Mike Rowe should have stuck it out. It would have been Mike Rowe and the whole world against Microsoft on this one.
