The price went up—what else—from $69.99 dollars to $119.99 dollars. That’s almost $120 bucks just to attempt to get through to a domain owner in order to inquire whether they are willing to sell a domain! There is no guarantee a registrant would respond, let alone be willing to sell.

I can understand wanting to qualify a potential buyer, so you don't waste your time with 'tire kickers'. But, to an extent, you're also taking advantage of them. You should consider offering refunds if:

1. The domain owner doesn't respond. You wasted a couple minutes with a phone call and email.
2. The domain isn't for sale. Again, a couple minutes.
3. The domain owner wants a totally unrealistic price for the domain. Maybe a few minutes more to try to talk some sense into them. But still...

Also, keep in mind, real estate agents don't ask for a fee up front and they do a lot more work showing properties...

If that's the case, then kudos to you. I wasn't assuming, I took your website's word for it:

"If we are unable to acquire the domain, the domain broker will close your claim after 30 days or after the domain owner decides not to sell their domain name. The $119.99 fee stands, as it is non-refundable and non-transferrable."

yup, the legalese has to show the worst possible outcome, but we do have a human element here and try our best to let a customer off the hook when there is no chance of sale (custs have tried to buy google.com before)

Your brokerage service doesn't offer customers to buy Google.com but you are able to offer the brokerage service for apple.com?
