Found a great domain to register...

Greetings All,

I am very to new to domaining but I am learning quite a bit with the information here. I found a good name for a movie related domain and I also found a great domain for an adult one. So I typed it in through one of the registars and to my surprise it is available. I tripled check to make sure and all across the boards - it's totally available. I Googled it and a search came up for a male pornstar - the spelling is similar and I was going to let it go. Instinct took the better of me and I went to the Trademark Electronic Search System (TESS) and IT IS NOT trademarked by anyone.

SO... My question is should I register, develop, and then sell? OR do I register and just sell flatout? Hypothetically, the male pornstar may say one thing or two about it BUT it's not trademarked and my variation on it is different.

Any advice from the veterans of domaining would be greatly appreciated...

Famous people dont need to register a TM for their names to have protection and also neither do companies as they can be protected by common law TM.

Its hard to judge these things without knowing the name but my instincts tells me this would not a good development project (the guys name mispelled and topic). And without the development to fall back on i would pass on it

I forgot to mention that it's not his real name - and not even a stage name. Its one of those wordings that is addressed into the domain.

Another question: I noticed that many adult domains have Tube in them. Doesn't the "real" Tube mind and aren't they infringing on copyright/trademarks?

I'm not heavy into adult domains but it's one of the names that looks golden. BTW: The word has a universal appeal.

You could try to "taste" it to see if it gets any traffic, probably not...

Register it at Moniker then taste it for a few days. After you reg it, post here and I will give you my honest opinion about it.

You can also "taste it at godaddy and get a refund within 5 days. When you put the name it quotes on google how many search results come up?

Domain tasting is the practice of a domain name registrant using the five-day "grace period" (the Add Grace Period or AGP) at the beginning of the registration of an ICANN-regulated second-level domain to test the marketability of the domain. During this period, when a registration must be fully refunded by the domain name registry, a cost-benefit analysis is conducted by the registrant on the viability of deriving income from advertisements being placed on the domain's website.

In short - you can "try" domain in those few days and if you don't like it from some reason you can ask for refund. But have in mind that it's dependable from registrar to registrar. So, as some suggested above, use some reputable like Moniker or godaddy...
