I agree with the fact that it is not a good idea to throw bad money after good money.
I agree that businesses do fail and sometimes the owner cannot be blamed.
Not telling the truth, intentionally making false promises cannot be accepted.
Revenge does not have to be emotional though but a matter of calculation about moral values vs reward.
I will refrain from posting in this thread and will not start a second one, please let us go back to being friendly with Mike.

As most of you know my forum was delivered half As$, 2 months late and without many of the features I paid for..... I'm stuck now trying to find someone that is very experienced at phpBB 3 forums but I'm having no luck.

It was a really bad feeling waiting on the forum, not knowing when or if it would be delivered. Mike Danna at Vessio would tell me over the phone or in a message at the CP, "It's finished and ready for Upload" week after week and time after time. Some people here in this thread said "just keep waiting Dave" but I KNEW he was up to no good, You don't lie to a customer over and over. I really feel bad for everyone else who have not gotten what you've paid for to Mike - Vessio

For anyone wanting to persue Legal action, What about getting him for wire fraud? It seems like to me this is quite serious and is a felony in atleast some states. He's not even made an attempt to render services paid for to many customers so though I'm not sure of what's involved in deciding if this is where he fits but it seems like it to me. For anyone to say that crimes were not committed here is wrong. There are several possible crimes that Mike could be facing from petty theft to wire fraud.

Mike left a paper trail so long, there is no way he will get away with this.

I had about a 25 minute talk with Mike on the phone today.

I won't lay down any bs and provide you all with some facts.

Mike IS working on providing ALL a refund who have requested one. He is strapped for cash currently and this is the main reason for not seeing a refund if you have requested one.

He was purchasing several new machines, programs etc all for trying to catch up when the massive amounts of projects were coming in, in Oct, Nov.

He used a great deal of this money to buy the new equipment.

Now that the business has reached it's point, No New Projects are coming in. This also means that No Income is coming in.....

Mike is working hard to sell off some of his assets to cover everybodies refunds via the equipment he purchased.

I made it very clear that the Action will speak louder then words. Even if this means taking out a personal loan to cover refund fees.

As soon as the refunds are out, Mike will be back to "Normal" operation (pre-October) when everybody was enjoying his work and the near full 2 years he never once had a customer request a refund.

When the refunds are paid, I will be giving Mike another shot because he as Really learned his lesson. Knows now the amount of work he can take in and when it can get done and so on.

I do not want to put a time on when Mike will be sending refunds, because it's hard when you are selling physical items to recover funds. I can say he is working on this very hard. He feels very bad for what has happened and he wants to prove to everybody that he can get his business back to the way it was pre-October..

In fairness to Mike, he did contact me earlier today and left a voicemail as well as sending an email. But at this point I am too frustrated to deal with anymore excuses.

I have an open B of A dispute regarding the $320 Mike owes me. I had no choice but to file it since you have 60 Days, and it didn't look like a refund was going to happen. I told Mike days in advance about these actions I was planning on taking with no response.

I think it is clear that Mike's intentions never were to scam people. No scammer would leave a paper trail that long.

If Mike had been up front with me to start with, I would have been more understanding. But, eventually the excuses just wear a little thin.

I just got off the phone with Mike-vessio.
Jamie is head on, Mike is trying to resolve the issues with all parties that he has contact information for.
The situation that Mike-Vessio described is somewhat dark from a personal perspective, yet not hopeless from a business perspective.
I'm not going to get into details as to how Mike-vessio is going to generate the capital to issue refunds as this is solely his business decision.
However, Mike has assured me that he will remain in contact with all participants until the resolutions with delivery or refunds are resolved.

Whether Mike has "learned" his lesson of missing the time when to "pull the plug" on a great offer and can rectify the damage - only time can tell and only Mike can prove it.

Please continue to post your updates here in this thread, but keep it as professional as you've done.

All tickets were posted on his Beloved CP.

Good News........

My refund has Arrived in my Paypal account tonight from Vessio. I hope to hear a great deal more of this and Mike continues to do the right thing and again after speaking with him, it is clear to me that he is doing this and by the action of getting my refund.

I also received a refund. I will say after talking with Mike several times on the phone he is truly trying his best to take care of these issues.

My situation was a little different than everyone else's.

Mike had done exactly what I had asked him to do and sent me work in a timely manner. The reason I had requested a refund from the start was because we were having our programming done by another individual.

I have lost out over $400 on this too. I paid him in July for five sites. After months of failed multiple promises on all five sites , I finally sent an email to him. I did not expect an answer, and I never received one.

Today, I picked up the phone and called him. I was shocked that I received an answer. I politely asked for a refund. He said that he would give one, but he did not have the money right now. He would have it by the end of this month (January 2009).

I will post again if I ever see the refund.
