Unfortunately a member here had fallen prey to this illegal sale of our system - the problem being that the licenses are not transferable. While I wish this member the best in recouping the cost from 'Raf' above for this illicit sale, I would post here that no one be misled again. You cannot buy a 'used' copy of Whois.Cart(). This rule is in place to prevent explicit propagation of several sites on one license and there is no bending it or circumventing it.

To Raf, I hope that you will refund the mentioned member the value of Whois.Cart() that he may purchase a legal copy. While I am certain that you know that you infringed upon the EULA, I would hope that you recognize the ramifications of this transgression, and that this can be resolved amicably instead of the defrauded member having to press any type of charges against you for the violating sale that took place if such is his choice.

Here is the EULA clause in question:

The accompanying software source formally called Whois.Cart() ("Software") is licensed, not sold, to you (Licensee) by saeven.net consulting for use only under the terms of this License, and saeven.net consulting reserves any rights not expressly granted to you. You own the media on which the source is recorded or fixed, but saeven.net and its licensors retain ownership of the source itself.

1. License.

This License allows Licensee a non-exclusive, non-transferable license to use Software for the sole purposes of: (i) incorporating Software into Licensee's own website(s) or server(s) for Licensee's internal or commercial use under the terms of this Agreement (collectively "Licensee's Software"), subject to the terms and conditions set forth herein.

Remember that you agreed to this at purchase time, and that it is a legal binding.

This said, I hope that no one else is ever subjected to these circumstances, please always consult software companies when purchasing software from unofficial parties. Most software companies operate as such, with user-specific use-licenses which are not transferable at all - all for the same reasons.
