Hi,

I have a domain name, www.priceyline.com, and I contacted Priceline wanting to sell it, and an executive wrote back asking me my asking price. There is no site, or traffic - just the name. Also, could I get in to legal trouble with them over trademarks? I haven't given them my full name yet. But I'd really like to put a down payment on a house and need $$$ :) What should I ask?

I also have another url, www.SkinScientific.com. No site, just the name.

definitely a bad idea to go contacting them.... especially with a trademarked name you've displayed bad faith with

i already contacted them. what do i do now? they can't sue me, there's no site at that URL.

They could have sued from the very second you regged the name, but its not a likely scenario. Honestly they legally can take the name from you any time they want, lest you have a good domain attorney. But, since they seem interested, i would give it a go and try to milk it. Worst case scenario, they ask you to transfer the name to them. Best case scenario, they pay you for it. I am not a lawyer, this is just how I would deal with it in your shoes.

Are trademark laws that strict that Pricey line.com would be a TM issue?

It's not Price Line, does priceline have a TM on priceyline also. I guess I can't help you much there 'cause I am not too sure.
As far as contacting them to sell it, that was a bold move but one that may pay off. I would reply to them with a low asking price IMO, that way atleast they see you are reasonable. Maybe fib a bit and tell them you've had one other offer for 350 but you will give it to them for 200 as good faith to the similarities in the name.

Would it not cost them more than $200 to legaly pursue a TM infingment case?

What GG has posted is exactly the opposite of what I would. Infringing on a trademarked name does not mean the firm or individual has to own every variation of it. In a WIPO case, they need to prove that the name would cause confusion and dilute the trademarked name and show the name was purchased in bad faith (you offered to sell it t them).... again, if it was me, I would counter with $3,000, tell them you have an offer of $1,800 on the table and $3,000 is what you are looking for for an immediate close and transfer of the name. I would also state how some famous "names that became typos" like goggle sold for a lot of money just to spice the deal. Again, not a attorney, just how I wuld proceeed given past brush with TM names.

Well, personally i dont think there is anything wrong with the domain, pricey is a quite common slang nowadays so suing over it is not likely, but before you cotact them again, id advise you to set up a website, not aparking page or only adsense page but a website just to be on the safe side,.

I would keep the price of the domain at or below what anyone thinks it would cost for them to retain an attorney. Hard to say what anyone or any company will do these days.
