Anybody lost a trial for not finishing a Sedo transaction?

- someone made a bid on sedo and never pay;
- someone else listed a domain to a buy now price, I start the transaction but this was was cancel by sedo because the owner no longer owns the domain

sedo send me in both cases detail informations and they told me I can sue them in Germany acording to Germany lows

however, in one case the buyer that didnt pay is from Iran, and in the other case the seller that didnt own the domain anymore is from Romania

I am nout planing to sue anybody but just for curiosity: this sue thing realy works?

did anybody actualy lost a trial becouse didnt end up a sedo transaction?

whats happen is the end?

Well, in the second instance I don't think you have much of a case.

If someone lists a domain in the past, sells or drops it in the meantime, and it is still listed on SEDO with a BIN that is just not updating the inventory.

That is really no different that ordering a product online and then being told it is out of stock.

If they were actively negotiating back and forth like they still owned the domain, you might have a case there.

I think that sedo made a big mistake by forcing buy now price. Now it is harder to find domain at good price at sedo because many of them are set into too high prices and you can't negotiate them.
And there is also problem of not deleted domains by previous owners, before sedo forced using buy now price, seller could just cancel offer for domain and delete it from account.

This is some of the communication between myself and Sedo, where they were trying to force me into selling a domain, which was no longer parked with them and at a price I did not set. Sedo lied about the amount of commission that was to be paid to them for the sale and that I would receive a check in UK pounds sterling. They gave my personal information to the buyer and stated in no uncertain terms that, Sedo and or the buyer might sue me for breach of contract!!!!

I will not be selling xxxxxxxx.com. Sedo will have to explain to the buyer that, due to bank fees and that SEDO in all their years of existence, have not investigated other ways to distribute money to sellers. I find it bizarre that in an age where you can watch TV on your mobile phone, send a space probe to the outer reaches of the universe, Sedo have not moved on with the rest of the world and found other ways to transfer money to people without incurring bank fees!!! Get with the program you people, you are damaging your business.


How many years has Sedo been in existence?!!! Wasnโ€™t it 10 years recently!!!10 years and canโ€™t find a way to pay a seller without incurring bank fees 10 years!!! Pathetic!!!

So Sedo have lost a sale, so have I.

โ€œPlease note that, when a binding legal agreement is reached through Sedo, there is an obligation to pay Sedo the commission stipulated in that agreement.โ€

Get it into your thick heads, there is no binding agreement, I did not know this, or any of my other domains that I used to have parked at Sedo were for sale, nor did I set a sale price.

So I suggest Sedo stick there binding legal agreement where the sun donโ€™t shine.

As for this statement, โ€œSedo may pursue this commission, provided Sedo is not at fault for the cancellation of the transfer,โ€ try and enforce it and see what happens!!

I would have sold the domain through them, if it wasnโ€™t for the bullying tactics, lies lies lies and more lies. Sedo have a problem and I think it is due to !!!!!!!!!!!!!!!!! Co2.

Last year we started legal action against a person in Europe, who failed to complete the deal as a seller on Sedo. After some back and forth negotiations between lawyers, a settlement was proposed. But we would have paid nearly twice as much for the domain. The other option was to proceed with a lawsuit, in fact in it was nearly scheduled with the local courts.

For a number of reasons, we decided not to accept the settlement proposal and put an end to the process.
Short answer is that if the stakes justify it, you can sue the other party. But actually enforcing the contract will not be easy.
Suing is not difficult, just find a lawyer in the country of the deadbeat and give him/her a power of attorney to act on your behalf. No need to travel.
But the outcome is not guaranteed and things can drag on for a long time.

There are many cases where the seller forgot to delete the domain from his account (after the domain was sold somewhere else or simply dropped, etc.). Sedo sometimes controls this issue and sends you an email telling you that you should delete them, or that they will delete it theirselves because the whois no longer matches.

There is no reason why you would take legal actions against someone who simply forgot that or no longer owns the domains. I personally forgot some and deleted them way later in my account. Also i don't think that you will be successful with such a legal action

...not really off topic, just an addendum.

sedo has not kept up with the times, gouges the parties concerned and provides little protection.

Bodis gives me wider latitude than sedo does. I like them a whole lot more than the old rusting parking lot.

escrow(.)com is the way that I go and I have the buyer pay the fees incurred and it is cheaper for them to boot...
