Can anything be done with Androidstore.com? It was purchased in 1998 well before the android phone came out? Can it be sold?

An android is a robot. If you're selling robots, you're good. If you plan on sneaking in and acting as Google Play Store, that's a no no, no matter when it's registered. ;)

My friend purchased it in 1998 and still owns it. He also bought a androidparts.com and some others. When he bought it he was making a long term bet on real android machines.

Oh man, posting things like this in public is what get's people sued... I don't know what you people be thinking when you post TM's in public and draw attention to them... By the way, absolutely no point of having a TM unless the name(s) are racking up enough dough to pay the legal fees....

Did you ever look up Nominative Use?

We are not lawyers. Your friend will need to spend a few hundred $ to get this names potential, if any.

Get legal counsel.

Like Iconic said, you -or your friend- should seek legal counsel on this. It is a tricky thing to have names like that, no matter the register date, due to the huge TM impact of the name in question.

I would strongly urge you to do a search on G for similar cases that took place in the past. It is true that sometimes the holders of the name won but sometimes the company holding the trademark has won and the results weren't so nice.

I wish I could provide you with links but it's been quite some time since I did a research on those things.

There are some Trademarks for Android but ironically google does not have any of them.

I also think that he needs legal advice to avoid any legal problems with the use of the domain. Like will the android trademark attribution be enough for Google lawyers to be happy? Does his website infringe on any of the other trademark owners rights?

Finally, he isn't currently complying with Google's Trademark. So if Google wants to, they could go after the domain. If by court order, that's up to $100k per trademark infringement. They would have to go the court route because they'd probably lose any UDRP because they probably couldn't prove bad faith registration. That is unless they used John BerryHill as their attorney :)
