Afternic suspends my account due to violation

Hello Np'ers,

I listed Crypto/Gamers.com for $1,600 BIN and it was sold at afternic.com

I transferred the domain to LCN.com a day ago it sold and it has 60 days lockin period.

I informed buyer to create an account at lcn.com,so i can push immediately but buyer keeps initiating transfer at name.com, so i contacted afternic agent and informed about the ICANN 60 days lock period.

I clearly mentioned that i can't wait 60 days to complete the deal because domain trend is up and down but i can wait upto 15 days to create an account and get a push to lcn.com. I also emailed the same to buyer.

After 25 days i got offer of $2,500 from whois email and i sold to another buyer.

Afternic suspends my account due to violation of afternics tos :sour::meh:

JYI: I sold crypto/game.com for $85k at afternic.

I have received many offers @ afternic, possibly they will loose my sales commission :-P

There is no loss to me because if buyer needs the domain, he will come through my landing page / whois / sedo etc.,

What do you think about it?

Having dealt with more than a few "buyers" lately who have made offers that I have accepted and then either dragged it out, disappeared or come up with irrelevant excuses for why they will not perform, I think that you should have honored whatever terms you agreed to, whether in Terms of Service, or on this specific deal. Sellers should be held to the same standards as buyers of keeping their word.

Afternic should start offering futures contracts :-D This way, such dealings would be possible.

I'm kidding, of course. Customization of a process is not the norm in automated processes.

Depending on whether it was the OP's first offense or not, Afternic probably displayed maximum leniency. I'm definitely baffled by the OP's motives to go public with this.

One should respect the TOS of the marketplace. I don't support what you did. Although i appreciate that you are conversing politely with everyone. I see it as a bad judgement on your part, but hope you get a second chance at afternic :).

Maybe a suspension for 3 months or something, an outright ban is kind of silly. They are in the business of selling and if they lock out too many power users they might just put themselves out of business.

I'd think that the vast majority of power sellers do not walk out of a deal.
It puts Afternic in a difficult position vis-à-vis their customer, it's not just about fees lost on the present transaction and future opportunities.
One single unhappy customer can cause a lot of bad press (just imagine if the buyer is a prominent blogger). Non-completion of sales is something that any marketplace wants to avoid at all costs.
Some are more lenient than others though.

In theory you can even sue for breach of contract. While the odds of that happening are slim, people have to keep in mind this is not a game.

What would have happened in below case?

If a domain seller at afternic agrees to wait for the period till the domain gets unlocked but buyer doesn't wants to wait till that period and so asks to cancel the purchase ?

Will seller be suspended in this case too?
